RESOLUTION NUMBER: #25-23 DATE: NOVEMBER 10, 2025
On a motion of William LaScala, seconded by Robert Garrigan, and unanimously voted in
favor by Fon, LaScala, Bock, Garrigan, and Reardon, the following resolution was adopted:
WHEREAS, in accordance with the Planning Board's Land Development Regulations, Town
of Yorktown Town Code Chapter 195, adopted February 4, 1969 and as amended, a formal
application for the approval of a subdivision plat titled "Preliminary Resubdivision Map,"
prepared by JMC Planning, Engineering, Landscape Architecture, & Land Surveying, PLLC,
dated April 2, 2025, was submitted to the Planning Board on behalf of Toll Brothers, Inc.
(hereinafter referred to as "the Applicant"); and
WHEREAS the property owned by Field Home — Holy Comforter, is located at 2302 & 2448
Catherine Street, also known as Section 35.12, Block 1, Lot 2 and Section 35.08, Block 1, Lot
45 on the Town of Yorktown Tax Map (hereinafter referred to as "the Property"); and
WHEREAS, an application fee of $1,620.00 covering 2 Lots has been received by this Board;
and
WHEREAS on November 14, 2022, the Applicant submitted a petition to the Town Board
for an amendment to the Zoning Map of the Town of Yorktown to re -zone the properties
from the RSP -3 Age Oriented Geriatric Community and R1-40 One Family Residential zoning
districts to the RSP -2 Senior Citizens zoning district to permit the development of the property
with a 118 -unit townhome active adult community with various amenities, roads, utilities,
stormwater management infrastructure, landscaping, and related improvements.
WHEREAS the Applicant proposes to convey the Field Home Building to the Town for
preservation and reuse, and to accomplish this, proposes to resubdivide the property into two
parcels, and offer the Field Home parcel to the Town of Yorktown for a nominal price; and
WHEREAS after thorough review of the Petition, Full Environmental Assessment Form
("FEAF"), consisting of NYSDEC EAF Form Parts 1, 2 and an expanded Part 3 narrative
with attachments dated November 14, 2022 and correspondence for all involved agencies, on
December 10, 2024 the Town Board confirmed its status as Lead Agency; and
WHEREAS the Town Board determined that the proposed rezoning and Project constitute a

WHEREAS the Town Board requested verification of the wetland delineation and review of
the submitted tree survey, wetlands functional analysis, and wildlife habitat assessment by the
Town's Wetland Consultant, Barton & Loguidice, and received and considered comments
from said consultant dated November 29, 2022 and June 10, 2024; and
WHEREAS the Town Board requested review of the Historical Analysis, Conditions &
Adaptive Reuse report submitted by the Applicant by the Town's Historic Consultant,
Gregory Dietrich Preservation Consulting, and received and considered a letter from said
consultant dated June 7, 2024; and
WHEREAS the Town Board held a duly noticed public hearing on July 16, 2024, and
reconvened on September 3, 2024, at the conclusion of which the hearing was closed; and
WHEREAS the Town Board, consistent with the SEQRA regulations and based on the
comments received on the FEAF, the Applicant reduced the number of age restricted
townhouse units from 130 to 118 as well as reduce the development footprint of the Project;
and
WHEREAS the Town Board, on December 10, 2024, upon a finding that the Zoning Map
Amendment and the 118 -unit Project would not result in any significant adverse
environmental impact, adopted a Negative Declaration; and
WHEREAS on December 10, 2024, the Town Board adopted a resolution accepting the
FEAF as complete and that the rezoning of the Property from the RSP -3 and R1-40 zoning
districts to the RSP -2 zoning district is hereby granted; and
WHEREAS this two -lot subdivision of the Property is for the purpose of separating the
existing historic Field Home building (Field Home Parcel), from the remaining 47 acres, which
are the subject of a residential multifamily site plan for age -restricted housing in the RSP -2
zone, so that the Field Home Parcel can be transferred to another entity; and
WHEREAS, the applicant has submitted as part of this application the following maps and
documents:

1. A map titled "Preliminary Subdivision Map," prepared by JMC, PLLC, dated April 2,
2025 and last revised October 29, 2025; and
Improvement Plans
2. A plan set consisting of 52 sheets titled "Fieldhome at Catherine Street," prepared by

JMC Planning Engineering Landscape Architecture & Land Surveying, PLLC, dated
April 23, 2025, and last revised October 15, 2025; and
WHEREAS the Field Home, constructed between 1887 and 1924, for the purpose of
providing shelter for elderly and infirm women is cited in the Yorktown 2010 Comprehensive
Plan's chapter on historic resources and is identified therein as potentially eligible for New
York State National Register of Historic Places or as a locally designated landmark; and
WHEREAS the Town's 2006 Reconnaissance Level Historic Resource Survey identified the
building as potentially eligible for National Register of Historic Places; and
WHEREAS the Field Home Holy Comforter, the entity which owned and operated the Field
Home and the Nursing and Rehabilitation building, applied for and gained a circa 2000
rezoning and site plan approvals for a continuum -of -care project which proposed to retain
and preserve the Field Home; and
WHEREAS the same entity, after partial execution of the 2000 approval applied for and
gained another site plan approval in 2012 to further the continuum -of -care project which also
proposed to retain and preserve the Field Home or parts thereof; and
WHEREAS the Comprehensive Plan's guidance on such historic resources is for the Town
to endeavor to preserve and protect its historic resources where practical and achievable; and
WHEREAS the Town Board resolution dated December 10, 2024, stated and required that
the applicant subdivide a parcel containing the Field Home and transfer ownership to the
Town provided that the Town is in a position to accept the newly subdivided property for the
purposes of preservation and reuse; and
WHEREAS the Town Board has engaged a historic preservation architectural firm to evaluate
and develop a potential boutique hotel use for the Field Home; and
WHEREAS the Town Board will continue that effort to preserve the Field Home and to
identify interested operators/ owners for the reuse of the Field Home; and
WHEREAS, the Planning Board has reviewed the recreation needs created by the subject
subdivision as well as the present and anticipated future needs of the surrounding area as
analyzed and planned for in the Town's Recreation Plan adopted in 1978; and
WHEREAS, pursuant to Town Code Section §195-35(A)(1), approximately 10% of the total
area of a subdivision is required to be dedicated by the subdivider for a playground or active
recreation use;

WHEREAS, pursuant to Town Code Section §195-35(C), the Planning Board may accept
money in lieu of parkland reservation upon written application from the subdivider and
consideration of the following:
(a) The relationship of the subdivision to the town Plan, and particularly as such plan may
show proposed park and playground area;
(b) The character and recreation needs of the neighborhood in which the subdivision is
located;
(c) The unsuitability of land in the subdivision for park and playground purposes by reason
of location, access, grade or cost of development or maintenance;
(d) The possibility that land immediately adjoining the subdivision will serve, in whole or
in part, the park and playground needs of such subdivision; and
WHEREAS, the Planning Board has referred this application to the following boards and

WHEREAS, the requirements of this Board's Land Development Regulations, inter alia Town
Code Chapter 195, have been met; and
WHEREAS, a Public Informational Hearing was held in accordance with Town Code Section
§195-22A(5) of the Yorktown Town Code on the said subdivision application and plat at the
Town Hall in Yorktown Heights, New York on June 30, 2025; and
WHEREAS, having reviewed all current site plans, building plans, environmental plans and
reports, comments and reports from Town professional staff, the public, and other interested
and involved agencies associated with the application before it; and having conducted a public

hearing on the said site plan application in accordance with Town Code Section §195-22E
commencing on August 1, 2025, and continuing and closing on September 8, 2025 at Town
Hall in Yorktown Heights, New York;
BE IT THEREFORE NOW RESOLVED that the application of Toll Brothers Inc. for
approval of a subdivision plat titled "Preliminary Resubdivision Map," prepared by JMC,
PLLC, dated April 2, 2025, be approved subject to the following modifications and conditions
and that the Chairman and Secretary of this board be and hereby are authorized to endorse
this Board's approval on said plat upon compliance by the applicant with such modification
and additional requirements as noted. If such modifications are not made and such conditions
are not fulfilled within 180 days from the date of this resolution the plat shall be deemed
disapproved.
RESOLVED pursuant to the Town's recreation requirements, the residential site plan is
subject to the Town's recreation requirements in the Town Code and will be determined by
this Board in the site plan approval and the Field Home lot being already improved, is not
subject to donation of recreation lands or recreation fees in lieu of, and therefore the Planning
Board determines that there is no additional demand of recreational need that the Field Home
must meet; and
RESOLVED the plat shall be modified to show:
1. The area of the Field Home lot reflecting the updated lot line alterations.
2. The Applicant must include the following note regarding the Conservation Easement
on both the Plat and Site Plan:
"THE NATURAL. RESOURCES OF THE AREA WITHIN THE CONSERVATION EASEMENT
SHALL REMAIN UNDISTURBED, EXCEPT AS MAY BE REQUIRED FOR CONSERVATION
PURPOSES, UPON THE APPROVAL, OF THE PLANNING BOARD, CONTOURS THEREOF
SHALL NOT BE ALTERED, NO TOPSOIL OR UNDERLYING SOIL SHALL BE EXCAVATED
THEREFROM, NOTHING SHALL BE PERMITTED TO OCCUR ON THIS ARE WHICH WOULD
CONTRIBUTE TO THE EROSION OF THE LAND AND NO TREES SHALL BE DESTROYED
OR REMOVED AND NO OTHER PLANT OR VEGETATION SHALL BE DESTROYED OR
REMOVED. THE OWNERS OF FEE SIMPLE MAINTAIN THE RIGHT TO EXCLUSIVE USE OF
THE LAND AND ARE PERMITTED TO REMOVED DEAD VEGETATION AND TREES AND
REPLACE SAME WITH NEW PLANTINGS. THE DEVELOPER MAINTAINS THE RIGHT TO
CONSTRUCT THE IMPROVEMENTS DETAILED ON THE IMPROVEMENT DRAWINGS AND
WILL DEDICATE SAID IMPROVEMENTS WITHIN THE EASEMENT TO THE TOWN OF
YORKTOWN."
BE IT FURTHER RESOLVED, said plat map shall not be endorsed by the Planning Board
until:

1. Submission of required easements as shown on said plat, have been tendered to the
town to be held in escrow until formal acceptance by resolution of the Town Board;
and
2. Submission of a statement signed by the Town's Tax Collector that all taxes due on
this parcel have been paid; and
3. Submission of fees as per town requirements in the form of separate checks made
payable to the Town of Yorktown:
General Development $720.00
4. The plat has been reviewed by the Town Assessor; and
5. Submission of the plat signed by the Westchester County Health Department; and
BE IT FURTHER RESOLVED, the following additional requirements shall be met:
1. Applicant must submit final plat in AutoCAD DWG readable format; and
2. Provide monuments at all points of curvature and points of tangency as directed by
the Town Engineer at right-of-way/property line, for all lots; and
BE IT FURTHER RESOLVED, that upon due consideration by the Board no other
requirements of these regulations be modified; and
BE IT FURTHER RESOLVED, that the approved plat shall be recorded and filed in the
County Clerk's office within 30 days from the signature on the plat, otherwise said approval
shall become null and void.
