FIELDHOME AT CATHERINE STREET
RESOLUTION NUMBER: #25-24 DATE: NOVEMBER 10, 2025
On a motion of William LaScala, seconded by Robert Garrigan, and unanimously voted in
favor by Fon, LaScala, Bock, Garrigan, and Reardon, the following resolution was adopted:
WHEREAS in accordance with the Planning Board's Land Development Regulations, Town
of Yorktown Town Code Chapter 195, adopted February 4, 1969 and as amended, a formal
application for the approval of a site plan titled "Fieldhome at Catherine Street," prepared by
JMC Planning, Engineering, Landscape Architecture, & Land Surveying, PLLC, dated April
23, 2025, and last revised October 15, 2025 was submitted to the Planning Board on behalf of
Toll Brothers Inc. (hereinafter referred to as "the Applicant"); and
WHEREAS the property owned by Field Home — Holy Comforter, is located at 2302 & 2448
Catherine Street, also known as Section 35.12, Block 1, Lot 2 and Section 35.08, Block 1, Lot
45 on the Town of Yorktown Tax Map (hereinafter referred to as "the Property"); and
WHEREAS the Applicant submitted a petition to the Town Board for an amendment to the
Zoning Map of the Town of Yorktown to re -zone the properties from the RSP -3 Age
Oriented Geriatric Community and R1-40 One Family Residential zoning districts to the RSP -
2 Senior Citizens zoning district to permit the development of the property with a 118 -unit
townhome active adult community with various amenities, roads, utilities, stormwater
management infrastructure, landscaping, and related improvements.
WHEREAS the Applicant proposes to convey the Field Home Building to the Town for
preservation and reuse, and to accomplish this, proposes to resubdivide the property into two
parcels, and offer the Field Home parcel to the Town of Yorktown for a nominal price; and
WHEREAS after thorough review of the Petition, Full Environmental Assessment Form
("FEAF"), consisting of NYSDEC EAF Form Parts 1, 2 and an expanded Part 3 narrative
with attachments dated November 14, 2022 and correspondence for all involved agencies, on
December 10, 2024 the Town Board confirmed its status as Lead Agency; and
WHEREAS the Town Board determined that the proposed rezoning and Project constitute a
Type I action; and

WHEREAS the Town Board requested verification of the wetland delineation and review of
the submitted tree survey, wetlands functional analysis, and wildlife habitat assessment by the
Town's Wetland Consultant, Barton & Loguidice, and received and considered comments
from said consultant dated November 29, 2022 and June 10, 2024; and
WHEREAS the Town Board requested review of the Historical Analysis, Conditions &
Adaptive Reuse report submitted by the Applicant by the Town's Historic Consultant,
Gregory Dietrich Preservation Consulting, and received and considered a letter from said
consultant dated June 7, 2024; and
WHEREAS the Town Board held a duly noticed public hearing on July 16, 2024, and
reconvened on September 3, 2024, at the conclusion of which the hearing was closed; and
WHEREAS the Town Board, consistent with the SEQRA regulations and based on the
comments received on the FEAF, the Applicant reduced the number of age restricted
townhouse units from 130 to 118 as well as reduce the development footprint of the Project;
and
WHEREAS the Town Board, on December 10, 2024, upon a finding that the Zoning Map
Amendment and the 118 -unit Project would not result in any significant adverse
environmental impact, adopted a Negative Declaration; and
WHEREAS on December 10, 2024, the Town Board adopted a resolution accepting the
FEAF as complete and that the rezoning of the Property from the RSP -3 and R1-40 zoning
districts to the RSP -2 zoning district is hereby granted; and
WHEREAS the Town Board determined that the Project is subject to Site Plan approval by
the Planning Board and that the its resolution does not limit the Planning Board's authority to
exercise its authority pursuant to Chapter 195 of the Town of Yorktown Town Code in
implementing RSP -2 Zoning District standards and requirements; and
WHEREAS the applicant has submitted as part of his application the following maps and
documents:

WHEREAS the Field Home, constructed between 1887 and 1924, for the purpose of
providing shelter for elderly and infirm women is cited in the Yorktown 2010 Comprehensive
Plan's chapter on historic resources and is identified therein as potentially eligible for New
York State National Register of Historic Places or as a locally designated landmark; and
WHEREAS the Town's 2006 Reconnaissance Level Historic Resource Survey identified the
building as potentially eligible for National Register of Historic Places; and
WHEREAS the Field Home Holy Comforter, the entity which owned and operated the Field
Home and the Nursing and Rehabilitation building, applied for and gained a circa 2000
rezoning and site plan approvals for a continuum -of -care project which proposed to retain
and preserve the Field Home; and
WHEREAS the same entity, after partial execution of the 2000 approval, applied for and
gained another site plan approval in 2012 to further the continuum -of -care project, which also
proposed to retain and preserve the Field Home or parts thereof; and

WHEREAS the Comprehensive Plan's guidance on such historic resources is for the Town
to endeavor to preserve and protect its historic resources wherever practical and achievable;
and
WHEREAS the Town Board resolution dated December 10, 2024, stated and required that
the applicant subdivide a parcel containing the Field Home and transfer ownership to the
Town provided that the Town is in a position to accept the newly subdivided property for the
purposes of preservation and reuse; and
WHEREAS the Town Board is studying a potential adaptive reuse of the Field Home and has
awarded a contract to Beardsley Design Associates Architecture, Engineering, Landscape
Architecture D.P.C.; and
WHEREAS the Town Board will continue that effort to preserve the Field Home and to
identify interested operators/owners for the reuse of the Field Home; and
WHERAS the lot lines were moved from the initial proposal of the Field Home Parcel to
facilitate appropriate parking to achieve an adaptive reuse of the Field Home Building; and
WHEREAS the Planning Board has referred this application to the following boards and
agencies and has received and considered reports of the following:

WHEREAS the requirements of this Board's Land Development Regulations, Town Code
Chapter 195, have been met; and
WHEREAS the building materials and colors have been reviewed by the Advisory Board on
Architecture & Community Appearance and recommended for approval by this Board,

pursuant to their memo dated May 9, 2025; and
WHEREAS a Public Informational Hearing was held in accordance with §195-39(B)(1) of the
Yorktown Town Code on the said site plan application at the Town Hall in Yorktown Heights,
New York on June 30, 2025; and
WHEREAS the Applicant must provide at least 0.5 off-street parking spaces per dwelling unit,
plus an additional 10 parking spaces for staff, thereby requiring a total of 79 spaces, and the
applicant has shown 282 parking spaces on the site plan; and
WHEREAS due to the type of proposed project, the Planning Board has considered using a
parking count of 1.5 off-street parking spaces per dwelling unit, plus 10 additional spaces for
staff, thereby requiring a total of 187 spaces, to which the proposal complies; and
WHEREAS in accordance with Town Code Chapter 200, "Lighting, Outdoor," the applicant
has submitted a Lighting Plan as listed herein that meets all required outdoor lighting
standards; and
WHEREAS in accordance with Town Code Chapter 248, "Stormwater Management and
Erosion Sediment Control," the applicant has submitted a Stormwater Pollution Prevention
Plan as listed herein to control pollutant export and volume of stormwater runoff generated
from the project which includes reuse of a majority of the existing stormwater runoff
collection system with some modification and all the proposed impervious surfaces will be
collected and piped to one of the stormwater management systems where runoff reduction,
water quality treatment, and attenuation up to the 100 -year storm event will be managed; and
WHEREAS in accordance with Town Code Chapter 270, "Trees," the following measures are
proposed to mitigate the removal of 2,040 protected trees:
• Removal of 95 invasive trees;
• Planting of 956 new trees as part of the landscape plan as shown on Sheet C-020 as
listed herein; and
• Payment of $170,872.00 to the Town of Yorktown Tree Fund; and
WHEREAS in accordance with Town Code Chapter 178., "Freshwater Wetlands," the
applicant has proposed:
• A Wetland Mitigation Plan on the property for proper mitigation; and
• The removal of invasive species from the designated wetland areas to enhance and
preserve said areas on the property, as shown on the plan set; and
• To provide 3,500 plant plugs, 64 shrubs, and 956 trees throughout the entire site; and
WHERAS in accordance with New York State Town Law Section 274-a. 6, the Planning

Board must determine whether a proper case exists for requiring that a park or parks be
suitably located on the Property for playgrounds or other recreation purposes and this
determination must be based on an evaluation of the present and anticipated future needs for
park and recreational facilities in the town based on projected population growth to which the
project would contribute; and
WHEREAS the Planning Board has reviewed the recreation needs created by the Project as
well as the present and anticipated needs of the surrounding areas analyzed and planned for
in the Town's Recreation Plan adopted in 1978; and
WHEREAS the Planning Board may accept money in lieu of parkland reservation upon
written application from the Applicant and consideration of the following:
(a) the relationship of the Project to the town plan, and particularly as such plan may show
proposed park and playground area;
(b) The character and recreational needs of the neighborhood in which the Project is
located;
(c) The suitability of land on the Property for public park and playground purposes by
reason of location, access, grade or cost of development or maintenance;
(d) The possibility that land immediately adjoining the Property will serve, in whole or in
part, the park and playground needs of such development; and
RESOLVED, based on an assessment of the recreation needs created by the subject
subdivision, the recreation needs of the surrounding area reflected in the Town's Recreation
Plan, the Planning Board determined the Applicant will pay a fee in lieu in the amount of
$472,000.00; and
WHEREAS the Applicant shall convey the Field Home Buildings and associated 3.05 -acre
parcel ("Field Home Lot") to the Town of Yorktown for the purpose of historic preservation.
WHEREAS the Applicant shall contribute $150,000.00 to the Town of Yorktown to be used
to upgrade the Hunterbrook Upper Field (or other recreational facilities as determined by the
Town and subject to review and determination of the Planning Board during the Site Plan
review process as provided by law) and to mitigate the loss of the practice field on the Property
currently under lease to the Town through 2026; and
WHEREAS the Applicant shall contribute $170,500.00 to the Town toward Inflow and
Infiltration (I & I) mitigation for the Town to remove approximately 60,000 gallons of
stormflow from entering the Town sewer system discharging into the Hunterbrook Pump
Station, which meets the Town's requirement of 1:1.5 mitigation; and
WHEREAS the Applicant shall contribute approximately $55,000.00 to the Voluntary

Ambulance Corps (Mohegan EMS) in furtherance of the VAC acquiring four CPR units for
its vehicles; and
WHEREAS having reviewed all current site plans, building plans, environmental plans and
reports, comments and reports from Town professional staff, the public, and other interested
and involved agencies associated with the application before it; and having conducted a public
hearing held in accordance with §195-39(B)(2) of the Yorktown Town Code on the said site
plan application commencing on August 1, 2025, and continuing and closing on September 8,
2025 at Town Hall in Yorktown Heights, New York;
BE IT NOW RESOLVED that the application of Toll Brothers, Inc. for the approval of a
special use permit for a Specialized Residential Development, Age -Oriented Community and
site plan titled "Fieldhome at Catherine Street," prepared by JMC Planning, Engineering,
Landscape Architecture, & Land Surveying, PLLC dated April 23, 2025, and last revised
October 15, 2025, be approved subject to the modifications and conditions listed below, and
that the Chairman of this Board be and hereby is authorized to endorse this Board's approval
of said plan upon compliance by the applicant with such modifications and requirements as
noted below:
RESOLVED the Applicant must include the following note regarding the Conservation
Easement on both the Plat and Site Plan:
"THE NATURAL RESOURCES OF THE AREA WITHIN THE CONSERVATION EASEMENT SHALL
REMAIN UNDISTURBED, EXCEPT AS MAY BE REQUIRED FOR CONSERVATION PURPOSES,
UPON THE APPROVAL OF THE PLANNING BOARD, CONTOURS THEREOF SHALL NOT BE

RESOLVED the Planning Board received a letter from the Applicant's attorney dated April
23, 2025 stating their intent to contribute the $150,000.00 to the Town to be used for
maintenance of the Field Home; and
RESOLVED the Planning Board received a letter from the Applicant's attorney dated April
23, 2025 stating their intent to contribute the $150,000.00 to the Town to be used for upgrades
to the Hunterbook Upper Field or other recreational facilities to mitigate the loss of the
practice field; and

RESOLVED the Planning Board received a letter from the Applicant's attorney dated April
23, 2025 stating their intent to contribute the $170,500.00 to the Town to be used for Inflow

RESOLVED the Planning Board received a letter from the Applicant's attorney dated April
23, 2025 stating their intent to contribute the $55,000.00 to the Voluntary Ambulance Corps
(Mohegan EMS); and
RESOLVED pursuant to Yorktown Town Code Chapter 300 Article XIV Senior Citizens'
Development, which allows senior citizens' development the Planning Board has considered
and determined the following:
1. The proposed development is within 1,500 feet of the Crompond commercial business
hamlet;
2. A plan of development has been submitted as part of this Project;
3. Additional parking for staff and visitors has been provided;
4. All refuse shall be collected and kept within the building until scheduled pickup.
5. The Project includes accessory uses including both outdoor and indoor recreation and
amenity spaces to serve residents and their guests only; and
RESOLVED the Overall Preliminary Site Layout Plan listed herein was submitted and
reviewed by the Bureau of Fire Prevention and they recommended the removal or
modification of the center island in the northerly entrance to allow for a fire apparatus to enter
without encroaching into the opposing lane of traffic; and
RESOLVED the Applicant submitted a Fire Apparatus Turning Analysis depicting that a fire
apparatus can make the turn into the driveway without encroaching into the opposing lane of
traffic; and
RESOLVED should blasting be required, a site-specific blasting protocol shall be submitted
and shall ensure that all blasting activities would be protective of public health and safety to
the maximum extent practicable and at a minimum:
• Blasting activities would comply with applicable Town, County, and State codes;
• Blasting activities would be monitored by a licensed professional engineer;
• No blasting would take place without the proper permits being issued by the Town,
including but not limited to a blasting permit;
• The blasting contractor would provide the Town with proof of adequate liability
insurance;
• All blasts would be covered with metal rope or metal matting, or other suitable screens
of sufficient size, weight and strength, to prevent the escape of broken rock or other

material;
• All residents within 300 feet of the proposed blast location would be notified as to the
date and time that blasting would take place;
• Blasting would not be conducted after 5:00 pm or before 8:00 am, nor would it be

• During blasting operations, explosives would be stored separately from igniters,
explosives would be stored in appropriate magazines, and no more than a one -day
supply of explosives would be stored on-site.
BE IT FURTHER RESOLVED the Planning Board adopted Resolution #25-23 approving
a Minor Subdivision for the Field Home at Catherine Street on November 10, 2025; and
RESOLVED that the newly subdivided Field Home parcel is transferred to the Town
provided the Town Board determines to accept the transfer of the parcel in accordance with
the Town Board Resolution dated December 10, 2024, but in no case later than 60 days after
the subdivision plat is recorded, but in the event the Town Board determines not to accept
transfer of the parcel in accordance with the Town Board resolution, this condition and the
condition requiring a contribution of $150,000.00 to the Town to be used for maintenance of
the Field Home shall be null and void; and
RESOLVED the Applicant shall modify clans to show:
Revise the title of page C-110 to Fire Apparatus Turning Analysis; and
2. Correct the updated area of the Field Home parcel on the Plat as the property lines
have been altered; and
3. Correct the mitigation chart to only show the mitigation methods within the mitigation
area; and
Additional conditions that must be completed prior to signature of the approved site
plan by the Planning Board Chairman:
1. Applicant must obtain SWPPP approval from the Department of Environmental
Protection; and
2. Submission of.all legal documents to effectuate the easement and other agreements set
forth on the map or its notes, in form satisfactory to the Town Attorney; and
3. Add notes to the Plat and Site Plan regarding easements; and

4. Submission of a Final Stormwater Pollution Prevention Plan acceptable to the Town
Engineer and approved by the Planning Board; and
5. Submission of the amounts below in the form of separate checks made payable to the
Town of Yorktown, and held in escrow with the Town Attorney until such time that
closing occurs between the Applicant and the current owner of the Property, except for
the Field Home Maintenance Fee, which shall be held in escrow with the Town
Attorney until the latter of such time that the Town Board determines not to accept
transfer of the Field Home Parcel or when tide for the parcel is conveyed to the Town:

6. Submission of a fee as per town requirements made payable to the Town of Yorktown
and submitted to the Planning Department:

Engineer's requirements and acceptable to the Town Attorney and the Planning Board:

to the proposed screening of the Field Home parcel; and
10. The Applicant shall submit a draft of a conservation easement or similar document to
the satisfaction of the Planning Board and Town Attorney preserving in perpetuity the
approximately 14.34 -acre portion of the Property shown on the plat tided, "Preliminary
Resubdivision Map," prepared by JMC, PLLC, dated April 2, 2025, as conservation
space; and

11. Proposed plan must comply with all current applicable ADA standards.

13. Submission of all legal documents to effectuate the offers of cession, road dedications,
easement, and other agreements set forth on the map or its notes, in form satisfactory
to the Town Attorney.
14. Applicant must obtain all necessary permits from outside agencies.
Conditions that must be met prior to the commencement of site development work:
15. A Town of Yorktown Building Permit must be obtained. If required a floodplain
development permit must be obtained.
16. All required erosion and sediment control measures shall be installed as per the
engineering plans and as required by the NYSDEC Standards and Specifications for
Erosion & Sediment Control.
17. All other permits required by regulatory authorities (if any) shall be obtained.
18. A pre -construction meeting must be held at the site. The applicant or a representative
shall contact the Engineering Department (914) 962-5722 x220 to arrange this meeting.
All erosion controls and limits of disturbance lines (such as silt fence and orange
construction fencing) are to be installed prior to this meeting.
BE IT FURTHER RESOLVED the subject approval is for a residential site plan in the RSP -
2 Senior Citizen zoning district, which is a Specialized Residential Development, Age -Oriented
Community as defined by the Town Code §300-3 as:
A project consisting of one -family, two-family, row houses or multiple dwellings, and
accessory structures, occupying a lot or site to be held in a single ownership or common
ownership, and arranged, designed or operated as a complete project to provide housing
and accessory community facilities for the following persons: single individuals 55 years of
age or older; married couples, at least one of whom is 55 years of age or older; or two or
three persons of whom only one may be under 55 years of age, if such one person is
residing with a person or persons 55 years of age or older, provided that the presence of
such person is reasonably required for the physical care and support of the person or

and therefore, should the Applicant or any future owners or operators of the Project seek to
offer residence to those below this age restriction, the applicant must return to the Planning
Board for evaluation of the environment impacts of this change including but not limited to
the impact on the schools, community services, and recreation needs of the Property; and
RESOLVED, that in accordance with Town Code Chapter 200, "Lighting, Outdoor," the
proposed lighting plan is approved subject to the conditions listed therein; and
BE IT FURTHER RESOLVED, that in accordance with Town Code Chapter 248, Chapter
178, Section §300-228(A), and Chapter 270, the application of Toll Brothers, Inc. for the
approval of a Stormwater Pollution Prevention Plan, Wetland, and Tree Removal Permit
#T-WP-FSWPPP-023-25 is approved subject to the conditions listed therein; and
RESOLVED, Permit #T-WP-FSWPPP-023-25 shall not be valid until it has been signed by
the Chairman of this Board;
RESOLVED the Planning Board has waived the requirement for sidewalks as per Town Code
Section 195-31; and
RESOLVED the Applicant will retain an independent third -party Environmental Systems
Planner, a "Qualified Inspector" as defined by the New York State Department of
Environmental Conservation in the SPDES General Permit for Stormwater Discharges from
Construction Activity, to supervise and be present during the construction of the erosion
control measures, and which Environmental Systems Planner will provide bi-weekly
inspection reports regarding the status of erosion control measures to the approval authority
via the Town Engineer and the Planning Department throughout construction; and
RESOLVED the Applicant must notify the Planning Board in writing stating the name of the
Environmental Systems Planner or Firm that will be completing the bi-weekly inspection
reports and shall notify the Planning Board in writing if this Planner or Firm changes; and
Additional conditions that must be completed prior to issuance of a First Certificate
of Occupancy

20. The Applicant shall relocate the water line serving the Field Home Building and prepare
amended access and utility easements for the Field Home Lot; and
21. The Applicant shall undertake certain offsite improvements to Catherine Street,
including construction of a 6" rolled asphalt curb on Catherine Street along the Project
Site's frontage to a termination point at the intersection of Old Crompond Road to the
satisfaction of the Highway Superintendent, the adjustment of existing catch basins as
necessary, and the installation of rip rap behind the new curb as needed at the direction
of the Town Highway Superintendent; and
22. The Applicant shall clear and prune vegetation as needed along the Catherine Street
frontage and along site frontage at the proposed site driveways, to ensure adequate
sight distances for entering and existing vehicles; and
Additional conditions that must be completed prior to the issuance of a Final
Certificate of Occupancy
23. The Applicant must remove the temporary sales office from the Field Home property;
and
RESOLVED the Applicant shall utilize dark sky -compliant lighting throughout the site
development and always maintain them as such; and
RESOLVED the approved Site Plan shall be maintained on the work site throughout the
development; and
RESOLVED the Applicant shall submit an as -built survey to the Planning Department and
certify all site work has been completed in compliance with the approved site plan and
architectural elevations and request a final site inspection and sign off by the Planning Board
prior to the issuance of a certificate of occupancy; and
RESOLVED that the special use permit for a Specialized Residential Development, Age -
Oriented Community shall be considered null and void if a building permit is not issued within
one year from the date of the Planning Board Chair signing the Site Plan, unless the special
use permit is extended by the Planning Board upon request by the Applicant submitted no
later than 30 days prior to the date of expiration.
BE IT FURTHER RESOLVED that unless a building permit has been issued within one (1)
year of the date of this approval, which is November 10, 2026, or a time extension has been
granted by the Planning Board, this approval for a Site Plan, Special Use Permit, Stormwater
Pollution Prevention Plan, Wetland Permit, and Tree Permit will be null and void.
