Application for Site Plan & Special Permit Approvals

Dear Chairman Fon and Members of the Planning Board:
This firm represents Jacob Solar 2344 NY, LLC ("Freestone" or "Applicant") in
connection with Freestone's applications for Site Plan and Special Permit approval to facilitate its
proposed development of a large-scale solar energy system on the Property ("Project"). We are
writing to request placement on your Board's January 26, 2026 Work Session Agenda to continue
review of this Project.
At the November 10th Work Session, Freestone presented a modified layout for the Project.
The modified layout presented complies with both the current zoning provisions regulating the
design of solar developments in the Town, as well as the Town Board's proposed amendments to
these provisions. While the revised layout presented in November would keep the Project cost
effective for Freestone to develop while continuing to avoid any potential adverse impacts to the
surrounding community, it did require eliminating the trail approved as part of the Colangelo
Subdivision. As a result, your Board recommended that the Applicant coordinate with the Property
owner to amend the Colangelo Subdivision before returning to the agenda on this Application.
We are happy to report that Freestone has worked with the Property owner to find a way
to relocate the trail, rather than eliminate it. The enclosed Site Plan, prepared by LaBella, dated
January 12, 2026, shows a feasible option in which the trail would run along the western side of
the Property between the tree line and the fence enclosing the solar array. This modification will
allow the Property owner to maintain the trail as a recreational amenity for the public's benefit,
while also maintaining the solar Project. We respectfully submit that relocating the trail as shown
on the enclosed plan would not require a wholesale amendment to the Colangelo Subdivision that

would delay the Project review further, but rather, could be processed as part of your Board's final
subdivision plat approval.
Accordingly, the Applicant requests that the Board place this Application on its next
agenda. We respectfully submit that with the submission of a proposed plan for the relocation of
the trail, Freestone's plan, as modified, is ready for public comment. Accordingly, we ask that your
Board schedule the public hearing on this Application for the February 9th meeting.
