PERMIT FOR THE AMS YORKTOWN ACTIVE ADULT COMMUNITY
RESOLUTION NUMBER: #25-21 DATE: OCTOBER 20, 2025
On motion of William LaScala, seconded by Robert Garrigan, and unanimously voted in favor
by Fon, LaScala, Bock, Garrigan, and Reardon, the following resolution was adopted:
WHEREAS in accordance with the Planning Board's Land Development Regulations, Town
of Yorktown Town Code Chapter 195, adopted February 4, 1969 and as amended, a formal
application for the approval of a site plan tided "AMS Yorktown Active Adult Community,"
prepared by Site Design Consultants, dated July 30, 2025, and last revised August 22, 2025 was
submitted to the Planning Board on behalf of 800 East Main Street Dev AMS LLC (hereinafter
F referred to as "the Applicant"); and
WHEREAS the property owned by Contractors Register, Inc. is located at 800 East Main
Street, Jefferson Valley, also known as Section 5.19, Block 1, Lot 15 on the Town of Yorktown
Tax Map (hereinafter referred to as "the Property"); and
WHEREAS on October 24, 2022, the Applicant submitted a petition to the Town Board for:
(i) amendments to the Zoning Code of the Town of Yorktown generally affecting the RSP -2
F Senior Citizens District of the Town; and (ii) an amendment to the Zoning Map of the Town
of Yorktown to re -zone the Property from OB Research Laboratory and Office District to
F RSP -2 Senior Citizens District of the Town to permit the redevelopment of the Property with
an active adult residential community available to adults aged 55 and over, consisting of
approximately 250 dwelling units including a mix of rental units and for -sale townhomes,
together with amenities, 383 parking spaces and related infrastructure; and
WHEREAS after thorough review of the Petition, Full Environmental Assessment Form
dated November 1, 2022, and correspondence from all interested and involved agencies, on
March 7, 2023 the Town Board confirmed its status as Lead Agency, adopted a Positive
Declaration with respect to the submitted petition and directed the Applicant to prepare and
submit a draft scope for a draft environmental impact statement ("DEIS"); and

WHEREAS on April 4, 2023, the Town Board (i) conducted and closed a duly noticed public
F scoping session, at which all persons in attendance having comments were heard; and (ii)
resolved that the written comments on the DEIS Scope would be accepted until the close of
business on April 14, 2023; and

WHEREAS on May 2, 2023, the Town Board adopted the DEIS Scope dated May 2, 2023;
and
WHEREAS on July 10, 2024, the Applicant submitted a preliminary draft DEIS to the Town
Board and the Town Board accepted and (i) held a duly noticed public hearing on the DEIS
commencing on September 3, 2024 and closing on October 8, 2024, at which all persons in
attendance having comments were heard; and (ii) resolved that the written comments on the
DEIS would be accepted until the close of business on October 18, 2024; and
WHEREAS on February 14, 2025, the Applicant submitted a preliminary Final Environmental
F Impact Statement ("FEIS") to the Town Board; and
WHEREAS consistent with SEQRA regulations (6 NYCRR section 617.9(b)(8)) and based
on comments received on the DEIS, the Applicant developed the "Revised Proposed
Project," which the Applicant identified in the FEIS as its current preferred alternative. The
Revised Proposed Project is similar to, and an evolution of, the Alternative Site Layout
F described in the DEIS, but has fewer residential units, and comparatively further reduces site
disturbance, slope disturbance, parking, impervious areas, and tree removal quantities
compared to both the Original Project and the Alternative Site Layout discussed in the DEIS.
The Revised Proposed Project consisted of 180 -units of age -restricted multifamily housing in
two buildings, consisting of 60 one -bedroom units and 120 two-bedroom units; and
WHEREAS on February 25, 2025 the Town Board adopted a resolution accepting the FEIS
as complete and directed that the FEIS be filed with the appropriate agencies and be made
available to the public; and
WHEREAS pursuant to Section 617.11 of the SEQRA Regulations, on May 13, 2025 the
Town Board (i) adopted a written findings statement determining that the Revised Proposed
Project would not result in unavoidable significant adverse impacts, and that the mitigation
measures incorporated into the project and the additional measures required by the Findings
Statement mitigate adverse impacts to the maximum extent practicable; and (ii) adopted Local
Law No. 7 of 2025 amending the Chapter 300 attachment 1 (Appendix A) of the Zoning Code
to allow a maximum height (feet) may be increased to 55 feet for main buildings on sites
greater than 25 acres; and (iii) adopted Local Law No. 8 of 2025 amending the Zoning Map
of the Town of Yorktown to rezone the Property RSP -2 Senior Citizens District to
accommodate a proposed age -restricted residential redevelopment project; and
WHEREAS the additional measures required by the Findings Statement to be considered by
the Planning Board during the site plan review process are:
• A tree mitigation plan that includes planting of native species, removal of invasive
species, a tree protection plan, preservation of existing vegetation and tree buffers,

planting of conifers in strategic locations to augment visual screening, and the potential
donation of trees to the Town tree nursery at Willow Park;
• Consideration of an additional contribution for recreational demand created by the
Project pursuant to New York State Town Law §274-a. 6;
• Confirmation with Con Edison that no off-site mitigation measures are necessary to
serve the Project;
• A feasibility study to determine if solar power can be utilized;
• The safety of pedestrians that may occasionally use the Project site driveway in the
absence of sidewalks shall be considered in the final driveway design;
• The Applicant and the Town will investigate the possibility of adding sidewalks along
East Main Street;
• The final design of mechanical systems to confirm that no significant noise level
increment will result;
• A detailed Construction Management Protocol, which shall formalize the measures to
avoid and mitigate potential adverse impacts during construction;
• A site-specific blasting protocol should it be determined that blasting is required;
• If additional green building technology can be incorporated into the Project; and
WHEREAS the Site Plan is consists of 180 -units of age -restricted multifamily housing in two,
four-story buildings, consisting of 72 one -bedroom units and 108 two-bedroom units, together
with 271 parking spaces and related site infrastructure ("the Project"); and
WHEREAS the Applicant has submitted as part of the application the following maps and
documents:

WHEREAS the requirements of this Board's Land Development Regulations, Town Code
Chapter 195, have been met; and

WHEREAS the building materials and colors have been reviewed by the Advisory Board on
Architecture & Community Appearance and recommended for approval by this Board,
pursuant to their memo dated September 3, 2025; and
WHEREAS a Public Informational Hearing was held in accordance with §195-39(B)(1) of the
Yorktown Town Code on the said site plan application at the Town Hall in Yorktown Heights,
New York on July 14, 2025; and
WHEREAS having reviewed all current site plans, building plans, environmental plans and
reports, comments and reports from Town professional staff, the public, and other interested
and involved agencies associated with the application before it; and having conducted a public
hearing held in accordance with §195-39(B)(2) of the Yorktown Town Code on the said site
plan application commencing and closing on September 8, 2025 at Town Hall in Yorktown
Heights, New York; and
WHEREAS the applicant must provide at least 0.5 off-street parking spaces per dwelling unit
thereby requiring a total of 90 parking spaces, and the applicant has shown 271 parking spaces
on the site plan; and
WHEREAS in accordance with Town Code Chapter 248, "Stormwater Management and
Erosion Sediment Control," the applicant has submitted a Stormwater Pollution Prevention
Plan as listed herein to control pollutant export and volume of stormwater runoff generated
from the project which includes reuse of a majority of the existing stormwater runoff
collection system with some modification and all the proposed impervious surfaces will be
F collected and piped to one of the stormwater management systems where runoff reduction,
water quality treatment, and attenuation up to the 100 -year storm event will be managed; and
F
WHEREAS in accordance with Town Code Chapter 270, "Trees," the following measures are
F proposed to mitigate the removal of 188 protected trees:
• Removal of 36 invasive trees;
M• Planting of 57 new trees in the woodland to strengthen the existing forest as shown on
Sheet PT as listed herein;
F • Planting of 151 new trees as part of the landscape plan as shown on Sheet LTR as listed
herein; and
WHEREAS in accordance with New York State Town Law §274-a. 6, the Planning Board
must determine whether a proper case exists for requiring that a park or parks be suitably
located on the Property for playgrounds or other recreation purposes and this determination
must be based on an evaluation of the present and anticipated future needs for park and

recreational facilities in the town based on projected population growth to which the Project
would contribute; and
WHEREAS the Planning Board has reviewed the recreation needs created by the Project as
well as the present and anticipated future needs of the surrounding area as analyzed and
planned for in the Town's Recreation Plan adopted in 1978 and as expressed in the memo
from the Recreation Commission dated September 4, 2025; and
WHEREAS the Planning Board may accept money in lieu of parkland reservation upon
written application from the Applicant and consideration of the following:
F (a) The relationship of the Project to the town plan, and particularly as such plan may
show proposed park and playground area;
F (b) The character and recreational needs of the neighborhood in which the Project is
located;
(c) The suitability of land on the Property for public park and playground purposes by
reason of location, access, grade or cost of development or maintenance;
(d) The possibility that land immediately adjoining the Property will serve, in whole or in
F part, the park and playground needs of such development; and
WHEREAS the Planning Board received a letter from the Applicant's attorney dated August
22, 2025 outlining the on-site active and passive recreational facilities that will serve the
demand of the residents and requested the Planning Board accept these improvements as
partially meeting the demand of the new residents and offered a fee in lieu of public
` recreational facilities on the Property in the amount of $225,000.00; and
BE IT NOW RESOLVED pursuant to SEAR, the Planning Board accepts and adopts the
Findings Statement adopted by the Town Board on May 13, 2025 and incorporates the
conditions of said findings as noted below; and
BE IT FURTHER RESOLVED that the application of 800 East Main Street Dev AMS LLC
for the approval of a site plan titled "AMS Yorktown Active Adult Community," prepared by
Site Design Consultants, dated July 30, 2025, and last revised August 22, 2025, be approved
subject to the modifications and conditions listed below, and that the Chairman of this Board
be and hereby is authorized to endorse this Board's approval of said plan upon compliance by
the applicant with such modifications, conditions, and requirements as noted below; and
RESOLVED the Planning Board has determined based on the on-site active and passive
recreational facilities provided by the Applicant as part of the Project, a fee in lieu of public
recreational facilities in the amount of $225,000.00 is sufficient to mitigate the demand on
town recreation programs and facilities the Project is projected to contribute; and

RESOLVED pursuant to Yorktown Town Code Chapter 300 Article XIV Senior Citizens'
Development, which allows senior citizens' development the Planning Board has considered
and determined the following:
1. The proposed development is within 1,500 feet of the Jefferson Valley commercial
business hamlet;
N2. A plan of development has been submitted as part of this Project;
3. Additional parking for staff and visitors has been provided;
4. All refuse shall be collected and kept within the building until scheduled pickup.
5. The Project includes accessory uses including both outdoor and indoor recreation and
amenity spaces to serve residents and their guests only; and
F
RESOLVED the Town Board approval required the Applicant obtain approval from the New
F York State Department of Transportation for the proposed measures to mitigate the impact
of the Project on the East Main Street & U.S. Route 6 and the East Main Street & Old Route
6 intersections as follows:
�" • Installation of new traffic signals to be operated by one controller as a "clustered"
intersection;
• Extension of the existing eastbound left turn lane on U.S. Route 6 to 300 feet;
• Addition of a northbound right land at the Old Route 6 and East Main Street
intersection;
• Restriction of left turns from East Main Street onto U.S. Route 6;
• The final signal design shall be coordinated with the U.S. Route 6 signals at the Taconic
State Parkway and at Barger Street; and
RESOLVED approval and substantial completion of the construction of the traffic mitigation
improvements proposed for the East Main Street & U.S. Route 6 and the East Main Street &
Old Route 6 intersections shall be required prior to issuance of a Certificate of Occupancy;
and
RESOLVED in consideration of the safety of pedestrians who may occasionally walk to the
F site entrance, it was determined that a sidewalk on the site entrance would be too steep,
however the Applicant has offered a walking path that connects the southern parking lot to
the site entrance through the managed landscaped areas and the Planning Board determined
this alternative would offer an option for pedestrians to use instead of walking on the site
driveway and this path shall be maintained for access in good weather; and

RESOLVED the Applicant considered the installation of sidewalks along East Main Street
however the Planning Board determined limitations including cutting and grading of steep
slopes and the relocation of utility poles would make the construction of a sidewalk difficult
at this time; and

RESOLVED the Fire Access Plan listed herein was submitted and reviewed by the Bureau of
Fire Prevention and they recommended the removal of the center median in the site driveway
and therefore this was eliminated from the site plan; and
RESOLVED should blasting be required, a site-specific blasting protocol shall be submitted
and shall ensure that all blasting activities would be protective of public health and safety to
the maximum extent practicable and at a minimum:
• Blasting activities would comply with applicable Town, County, and State codes;
• Blasting activities would be monitored by a licensed professional engineer;
• No blasting would take place without the proper permits being issued by the Town,
including but not limited to a blasting permit;
• The blasting contractor would provide the Town with proof of adequate liability
insurance;
• All blasts would be covered with metal rope or metal matting, or other suitable screens
of sufficient size, weight and strength, to prevent the escape of broken rock or other
material;
• All residents within 300 feet of the proposed blast location would be notified as to the
date and time that blasting would take place;
• Blasting would not be conducted after 5:00 pm or before 8:00 am, not would it be
conducted on a Sunday;
• No explosives would be stored on-site overnight; and
• During blasting operations, explosives would be stored separately from igniters,
explosives would be stored in appropriate magazines, and no more than a one -day
supply of explosives would be stored on-site.
RESOLVED the Applicant shall modify plans to show:
1. Revise parking requirement for the RSP -2 zone.
2. Add the meandering path from the southern parl6ng lot to the site entrance shown on
the Landscape Plan to the Site Plans. Add any additional grading necessary to make
this a comfortable walking path.
3. Comply with the Town Engineer's memo dated October 20, 2025, which requests the
following:
a. Provide grading and spot elevations for the courtyard area and the recreation
area.
b. Provide spot elevations for sidewalks around the proposed buildings.

c. Provide stabilized construction entrances in locations appropriate for access to
construction areas.
d. Ownership of water and sewer improvements needs to be resolved.
e. Existing sewers proposed to be utilized in the new project should be pressure
tested and television inspected.
f. Utility connections to all buildings should be shown.
g. A blow off hydrant should be provided in the high point of the watermain
(station 9+75).
h. Provide stations on the watermain plan.
i. Finalize design of the sewage pump station.
j. Provide a watershed map for the SWPPP report.
Additional conditions that must be completed prior to signature of the approved site
plan by the Planning Board Chairman and Application for a Building Permit:
1. Submit final design of the sewage pump station for review by the Town Engineer and
approval of the Planning Board.
2. Submit Final Stormwater Pollution Prevention Plan acceptable to the Town Engineer
and approved by the Planning Board.
3. Submit a copy of the proposed intersection improvement plans submitted to the New
York State Department of Transportation for approval.
4. Submit confirmation from Con Edison that no off-site mitigation measures are

1. Submit the final design of mechanical systems to confirm that no significant noise level
increment will result per NYSDEC guidelines.
2. Submit a detailed Construction Management Protocol, which shall formalize the
measures to avoid and mitigate potential adverse impacts during construction.
3. Submission of a site-specific blasting protocol should it be determined that blasting is
required.
4. Proposed plan must comply with all current applicable ADA standards.
5. Submission of all legal documents to effectuate the easements and other agreements
set forth on the map or its notes, in form satisfactory to the Town Attorney.
6. Applicant must obtain all necessary permits from outside agencies, unless otherwise
cited herein. If the Applicant cannot obtain a permit from an outside agency prior to
the time it applies for a Building Permit, the Applicant may request that the Planning
Board approve a modification to this condition upon a showing of good faith from the
Applicant.
Conditions that must be met 12rior to the commencement of site development work:
1. All required erosion and sediment control measures shall be installed as per the
engineering plans and as required by the NYSDEC Standards and Specifications for
Erosion & Sediment Control.
F 2. A pre -construction meeting must be held at the site. The applicant or a representative
shall contact the Engineering Department 914-962-5722 x220 to arrange this meeting.
All erosion controls and limits of disturbance lines (such as silt fence and orange
construction fencing) are to be installed prior to this meeting.
BE IT FURTHER RESOLVED the subject approval is for a residential site plan in the RSP -
2 Senior Citizen zoning district, which is a Specialized Residential Development, Age -Oriented
Community as defined by the Town Code §300-3 as:
A project consisting of one -family, two-family, row houses or multiple dwellings, and
N accessory structures, occupying a lot or site to be held in a single ownership or common
ownership, and arranged, designed or operated as a complete project to provide housing
and accessory community facilities for the following persons: single individuals 55 years of
age or older; married couples, at least one of whom is 55 years of age or older; or two or
three persons of whom only one may be under 55 years of age, if such one person is
residing with a person or persons 55 years of age or older, provided that the presence of

and therefore, should the Applicant or any future owners or operators of the Project seek to
offer residence to those below this age restriction, the applicant must return to the Planning
Board for evaluation of the environment impacts of this change including but not limited to
the impact on the schools, community services, and recreation needs of the Property; and
RESOLVED that in accordance with Town Code Chapter 248 and Chapter 270, the
application of 800 East Main Street Dev AMS LLC for the approval of a Stormwater Pollution
Prevention Plan and Tree Removal Permit #FSWPP-T-030-25 is approved subject to the
conditions listed therein; and
RESOLVED Permit #FSWPP-T-030-25 shall not be valid until it has been signed by the
Chairman of this Board;
RESOLVED the Applicant will retain an independent third -party Environmental Systems
F Planner, a "Qualified Inspector" as defined by the New York State Department of
Environmental Conservation in the SPDES General Permit for Stormwater Discharges from
Construction Activity, to supervise and be present during the construction of the erosion
control measures, and which Environmental Systems Planner will provide bi-weekly
inspection reports regarding the status of erosion control measures to the approval authority
via the Town Engineer and the Planning Department throughout construction; and
RESOLVED the Applicant must notify the Planning Board in writing stating the name of the
Environmental Systems Planner or Firm that will be completing the bi-weekly inspection
F reports and shall notify the Planning Board in writing if this Planner or Firm changes; and
Additional conditions that must be completed prior to issuance of a Certificate of
Occupancg.
1. Obtain approval and substantially complete the construction of the traffic mitigation
improvements proposed for the East Main Street & U.S. Route 6 and the East Main
Street & Old Route 6 intersections.
2. Submit a final as -built survey of the development to the Planning Department and
certify all site work has been completed in compliance with the approved site plan and
architectural elevations and request a final site inspection and sign off by the Planning
Board prior to the issuance of a certificate of occupancy for more than 60 percent of
the units. The Planning Board may approve a modification to this condition if certain
site improvements are not complete upon a showing of good faith by the Applicant,
