Director of Planning /nc Attachment Crompond / Croton Heights / Huntersville / Jefferson Valley / Kitchawan / Mohegan Lake / Shrub Oak / Sparkle Lake / Teatown / Yorktown / Yorktown Heights T[ -IIS IS TO CERTIFY that the attached copy is a true and correct copy of the Town of Yorktown Planning Board Resolution: PLANNING BOARD TOWN OF YORKTOWN RESOLUTION APPROVING AN AMENDED SITE PLAN FOR UNDERHILL FARMS DATE OF RESOLUTION: MARCH 2, 2026 HEREBY signed by the secretary of the Planning Board: G William LaScala, Secretary Ch Date PLANNING BOARD TOWN OF YORKTOWN RESOLUTION APPROVING AN AMENDED SITE PLAN FOR UNDERHILL FARMS RESOLUTION NUMBER: #26-07 DATE: MARCH 2, 2026 On motion of Aaron Bock, seconded by William LaScala, and unanimously voted in favor by, Fon, LaScala, Bock, Haughwout, and Reardon, the following resolution was adopted: WHEREAS, the property owned by the Applicant is located at 370 Underhill Avenue, Yorktown Heights, also known as Section 48.06, Block 1, Lot 30 on the Town of Yorktown Tax Map (hereinafter referred to as "the Property"), and the applicant has represented to this Board that they are the lawful owners of the land within said subdivision; and WHEREAS, the Property was the subject of a Subdivision, Site Plan, Stormwater Pollution Prevention Plan, Wetland, and Tree Permit approval for the project known as Underhill Farms that consists of a mixed-use development with 80 condominium units including: 48 townhouses, a 32 -unit 55+ senior restricted condominium building, and a mixed-use building consisting of 68 apartments and 15,600 square feet of retail/office space that includes 8,100 square feet of new retail space in addition to the reuse of the existing Underhill house on two separate parcels (hereinafter referred to as "the Site Plan Approval"); and WHEREAS, the Site Plan Approval and Subdivision were approved by Planning Board Resolutions #23-13, #24-12, #24-13, #25-09, and #25-11; and WHEREAS, requests for minor changes and additions to the site plan were submitted to the Planning Board by Underhill Soundview, LLC (hereinafter referred to as "the Applicant") in a letter dated November 20, 2025 and the Applicant's engineer, Site Design Consultants, in a letter dated January 28, 2026; and WHEREAS, said letters requested the following: The elimination of the requirement to install two of the approved crosswalks located at the northern and eastern sides of the Route 118 and Underhill Avenue intersection; and 2. Construction of an approximately 150 square foot irrigation pump house adjacent to the parking spaces near the pond to house the site's irrigation equipment; and 3. The relocation of townhouse building 11 from the northern side of the cul-de-sac to the eastern side of the cul-de-sac; and WHEREAS, the applicant has submitted as part of this request the following maps and documents: Plans 1. Shet LSK-3.2, tided `Building 11 — Cul -De -Sac," prepared by Blades & Goven Landscape Architects, dated February 20, 2026; and WHEREAS, the Planning Board has referred this application to the following boards and agencies and has received and considered reports of the following: Boards & Agencies ABACA Building Inspector Town Engineer Report Date 12/10/2025 No report submitted No report submitted WHEREAS, the ABACA reviewed the architectural plans for the proposed irrigation pump house and recommended approval using the following materials: • Roof shingles: GAF Timberline in the color of slate • Siding: Benjamin Moore in the color of Cottage Red • Windows: Marvin, aluminum clad wood in the color of black • Thin stone veneer to match the existing Underhill mansion; and BE IT NOW RESOLVED the Planning Board finds the following in regards to the requested changes to the approved site plan: RESOLVED, the Planning Board reaffirms that the approved crosswalks on the northern and eastern sides of the Route 118 and Underhill Avenue intersection are important for pedestrian connectivity between the Property and the Yorktown Heights Hamlet; and RESOLVED, the Planning Board finds that because the crosswalks are included in the open Underhill Farms Resolution #26-07 Amended Site Plan Approval Page 4 of 4 NYSDOT work permit for the Route 118 and Underhill Avenue intersection improvements, but were part of work that the Town Board decided could be delayed due to other additional costs for the improvements that have been completed and because the Town Board has committed to installing these crosswalks when funding is available, the crosswalks at the northern and eastern side of the intersection shall not be required to be completed by the Applicant; and RESOLVED, the Planning Board finds the construction of an approximately 150 square foot irrigation pump house as shown on the plans listed herein to house the site's irrigation equipment that will use water from the pond and stormwater is a minor change that will result in an environmental benefit on the site; and RESOLVED, the Planning Board finds the installation of backup generators for the apartment and condominium buildings is required to support the resiliency of the new buildings and residents that will be residing in them; and RESOLVED, the Planning Board finds the relocation of townhouse building 11 from the north side of the cul-de-sac to the east side of the cul-de-sac will result moving those units further away from the existing homes on Glenrock Street; and BE IT THEREFORE NOW RESOLVED the request of Underhill Soundview, LLC for minor changes to the approved site plan known as Underhill Farms and as shown on the plans listed herein, are approved as noted below and that the Chairman of this Board be and hereby is authorized to endorse this Board's approval of said plan; and BE IT FURTHER RESOLVED, all requirements of Planning Board Resolutions #23-13, #24-12, #24-13, #25-09, and #25-11, remain in full force and effect.
