Director of Planning /nc Attachment Crompond / Croton Heights / Huntersville / Jefferson Valley / Kitchawan / Mohegan Lake / Shrub Oak / Sparkle Lake / Teatown / Yorktown / Yorktown Heights THIS IS TO CERTIFY that the attached copy is a true and correct copy of the Town of Yorktown Planning Board Resolution: PLANNING BOARD TOWN OF YORKTOWN RESOLUTION APPROVING AN AMENDED SITE PLAN FOR UNDERHILL FARMS DATE OF RESOLUTION: April 21, 2025 HEREBY signed by the secretary of the Planning Board: William LaScala, Secretary Date PLANNING BOARD TOWN OF YORKTOWN RESOLUTION APPROVING AN AMENDED SITE PLAN FOR UNDERHILL FARMS RESOLUTION NUMBER: #25-11 DATE: April 21, 2025 On motion of William LaScala, seconded by Robert Garrigan, and unanimously voted in favor by Fon, LaScala, Bock, Garrigan, and Reardon, the following resolution was adopted: WHEREAS, the property owned by Underhill Soundview, LLC is located at 370 Underhill Avenue, also known as Section 48.06, Block 1, Lot 30 on the Town of Yorktown Tax Map (hereinafter referred to as the "Project Site") and is being developed by Unicorn Contracting Corp. (liereinafter referred to as the "Applicant"); and WHEREAS, on July 17, 2023 the Planning Board approved Resolution #23-13 for a site plan, special use permit, stormwater pollution prevention plan, wetland, and tree permit for the Underhill Farms development; and WHEREAS, on July 15, 2024 the Planning Board approved Resolution #24-13 for an amended site plan to effectuate the following changes to the approved site plan: 1. Relocation of parking spaces. 2. Relocation of two town home units from Building 1 into the condominium building. 3. Removal of the condominium pool area. 4. Relocation and reconstruction of the chapel building. WHEREAS, the Applicant has requested approval of additional amendments to the approved site plan including: 1. Relocation of parking spaces to accommodate new tenant in existing mansion house. 2. The reverting of the two town homes that were previously relocated out of the condominium building and back to Building 1. 3. Removal of the existing wooden foot bridge and replacing it with culverts to create a continuous level walking path around the pond. 4. Proposed addition to the existing mansion house to accommodate new tenant. WHEREAS, in support of this request, the Applicant has submitted the following documents: Amended Site Plan Sheets 1. Sheet C-101, titled "Zoning Data prepared for Underhill Farm," prepared by Site Design Consultants, dated June 22, 2020, and last revised February 18, 2025; and Underhill Farms Amended Site Plan Approval Resolution #25-11 Page 2of3 2. Sheet C-102, titled "Site Plan prepared for Underhill Farm," prepared by Site Design Consultants, dated June 22, 2020, and last revised February 18, 2025; and 3. Sheet C-105, titled "Improvement Plan prepared for Underhill Farm," prepared by Site Design Consultants, dated June 22, 2020, and last revised February 18, 2025; and 4. Sheet C-106, tided "Open Space and Recreation prepared for Underhill Farm," prepared by Site Design Consultants, dated June 22, 2020, and last revised February 18, 2025; and 5. Sheet LSP -3, tided "Landscaping and Site Lighting Plan," prepared by Blades & Goven Landscape Architects, dated July 20, 2023, and last revised February 1, 2025; and Underhill Farms Mansion Renovation 6. A drawing, Sheet A1.01, tided "Underhill Mansion Renovation (First Floor Tenant Schematic Plan)," prepared by Joseph G. Thompson Architect, PLLC, dated June 7, 2024, and last revised February 11, 2025; and WHEREAS, after further design and the securing of two tenants for the existing mansion house, additional parking is proposed that increases the parking spaces in front of the house from 7 spaces to 14 spaces; and WHEREAS, therefore the Applicant requests the following off-street parking spaces for the proposed uses: Use Townhomes Condominium Bldg Apartments Mixed -Use Comm. Mansion Re -use Provided 96 garage spaces 35 inside spaces 13 outside spaces 54 inside spaces 53 outside spaces 33 spaces 55 spaces 339 spaces Additional Provided 96 driveway spaces 3 tandem spaces 99 additional spaces thereby providing a total of 339 parking spaces on the site; and RESOLVED, the parking spaces on lot 48.06-1-30.2 on site may be used for the proposed senior center on the Beaver Ridge property between the hours of 8:00 a.m. and 5:00 p.m. on weekdays, and six (6) times per year outside those days and times upon two -week's written notice from the Town; and RESOLVED, access to the senior center from the road connection between the Beaver Ridge Property and the Underhill Farms Property; and RESOLVED, the Applicant is required to provide adequate provisions for access to and from Underhill Farms Resolution #25-11 Amended Site Plan Approval Page 3 of 3 the proposed building on the Beaver Ridge property. Final confirmation of these amenities is subject to review and acceptance of the Planning Board; and RESOLVED, the Planning Board approves the additional parking spaces added in front of the existing mansion house provided the revised Landscape Plan listed herein is strictly adhered to, to mitigate the view of these parking spaces from Underhill Avenue; and RESOLVED, shared parking spaces with the proposed senior center on the Beaver Ridge property shall be added to the parking schedule on sheet C-101; and RESOLVED, the latest proposed senior center footprint and entrance pathway shall be added to the site plan; and RESOLVED, the Planning Board approves the new proposed addition to the existing mansion house provided architectural plans must be reviewed and approved by the ABACA and to the satisfaction of the Planning Board in order to ensure the proposed addition. compliments the historic building and maintains the historic integrity of the house; and BE IT NOW RESOLVED, that the request of Unicorn Contracting Corp. for the approval of amendments to the signed site plan for the Underhill Farms project, be approved subject to the modifications and conditions listed herein, and that the Chairman of this Board be and hereby is authorized to endorse this Board's approval of said amended plans upon compliance by the applicant with such modifications and requirements; and BE IT FURTHER RESOLVED, all requirements of Planning Board Resolution #23-13 remain in full force and effect.
