Director of Planning /nc Attachment Crompond / Croton Heights / Huntersville / Jefferson Valley / Kitchawan / Mohegan Lake / Shrub Oak / Sparkle Lake / Teatown / Yorktown / Yorktown Heights THIS IS TO CERTIFY that the attached copy is a true and correct copy of the Down of Yorktown Planning Board Resolution: PLANNING BOARD TOWN OF YORKTOWN RESOLUTION APPROVING AMENDED SITE PLAN FOR UNDERHILL FARMS DATE OF RESOLUTION: JULY 15, 2024 HEREBY signed by the secretary of the Planning Board: William Lascala, Acting Secretary 202y- Date PLANNING BOARD TOWN OF YORKTOWN RESOLUTION APPROVING AN AMENDED SITE PLAN FOR UNDERHILL FARMS RESOLUTION NUMBER: #24-13 DATE: July 15, 2024 On motion of William LaScala, seconded by Aaron Bock, and unanimously voted in favor by Fon, LaScala, Bock, Phelan, and Waterhouse, the following resolution was adopted: WHEREAS, the property owned by Underhill Soundview, LLC is located at 370 Underhill Avenue, also known as Section 48.06, Block 1, Lot 30 on the Town of Yorktown Tax Map (hereinafter referred to as the "Project Site"); and WHEREAS, on July 17, 2023 the Planning Board approved Resolution #23-13 for a site plan, special use permit, stormwater pollution prevention plan, wetland, and tree permit for the Underhill Farms development; and WHEREAS, Unicorn Contracting Corp. (hereinafter referred to as the "Applicant") has requested approval of several amendments to the approved site plan including: 1. Relocation of parking spaces. 2. Relocation of two town home units from Building 1 into the condominium building. 3. Removal of the condominium pool area. 4. Relocation and reconstruction of the chapel building. WHEREAS, in support of dzis request, the Applicant has submitted the following documents: Amended Site Plan Sheets 1. Sheet C-102, titled "Site Plan prepared for Underhill Farm," prepared by Site Design Consultants, dated June 22, 2020, and last revised May 30, 2024; and 2. Sheet C-105, titled "Improvement Plan prepared for Underhill Farm," prepared by Site Design Consultants, dated June 22, 2020, and last revised May 30, 2024; and Underhill Farms Chapel Renovation PO 3. A drawing, Sheet G1.01, titled "Title Sheet," prepared by Joseph G. Thompson Architect, PLLC, and dated June 7, 2024; and 4. A drawing, Sheet A1.01, titled "Existing Plan," prepared by Joseph G. Thompson Architect, PLLC, and dated June 7, 2024; and 5. A drawing, Sheet AX2.01, titled "Existing Elevations," prepared by Joseph G. Thompson Architect, PLLC, and dated June 7, 2024; and F 6. Thompson Architect, PLLC, and dated June 7, 2024; and WHEREAS, pursuant to the Overlay Zone, d -le Proposed Project requirement for off-street parking may be guided by the requirements of the R-3 zone for the multi -family residential components of the development therefore 1.5 parking spaces are required for all 148 units in the Proposed Project, however due to the design of the project and the townhome units being along one side of the site without additional designated visitors spaces, the Planning Board has required these units provide 2 parking spaces, for each of the 48 townhome units; and WHEREAS, the Planning Board approved the following off-street parking spaces for the proposed uses: Use Townhomes Condominium Bldg Apartments Mixed -Use Comm. Mansion Re -use Provided 96 garage spaces 36 inside spaces 12 outside spaces 61 inside spaces 41 outside spaces 33 spaces 49 spaces 328 spaces Additional Provided 96 driveway spaces 3 tandem spaces 99 additional spaces thereby providing a total of 328 parking spaces on the site; and WHEREAS, after further design of the apartment building, 9 parking spaces were lost inside the building; and WHEREAS, due to the addition of a handicap space near the condominium building, 1 parking space was lost in this location and due to the relocation of handicap parking spaces to the west of the mansion, 2 parking spaces were lost in this location; and WHEREAS, to mitigate the loss of these 12 parking spaces, the Applicant added to the site plan 6 parking spaces adjacent to the chapel building and 7 parking spaces adjacent to the pond therefore adding back a total of 13 parking spaces; and Underhill Farms Resolution #24-13 Amended Site Plan Approval Page 3 of 3 WHEREAS, the Applicant was able to find a use for the chapel building as a residence and it will be reconstructed in the location shown on the amended site plan as detailed in the Underhill Farms Chapel Renovation plans listed herein; and WHEREAS, the Applicant has requested to add townhouse Building 3 to Phase 1 of the Erosion & Sediment Control plan, shown on Sheet C-104 of the signed site plan, in order to build the model units in this building; and BE IT NOW RESOLVED, the Planning Board determines the parking spaces added next to the pond are not desirable and an alternate location or design characteristics shall be investigated and finalized to the satisfaction of the Planning Board; and RESOLVED, the Planning Board approves the relocation and renovation of the Chapel as shown on the plans listed herein; and RESOLVED, the Planning Board amends Sheet C-104 of the approved site plan to include townhouse Building 3 in Phase 1 and the Applicant shall submit a revised plan reflecting this modification; and BE IT NOW RESOLVED, that the request of Underhill Soundview, LLC for the approval of amendments to the signed site plan for the Underhill Farms project, be approved subject to the modifications and conditions listed herein, and that the Chairman of this Board be and hereby is authorized to endorse this Board's approval of said amended plans upon compliance by the applicant with such modifications and requirement; and BE IT FURTHER RESOLVED, all requirements of Planning Board Resolution #23-13 remain in full force and effect.
