Our evaluation of the structure is to verify the existing capacity of the roof system and its ability to support the additional loads imposed by the proposed solar system. A. Site Assessment Information 1. Site visit documentation identifying attic information including size and spacing of framing for the existing roof structure. 2. Design drawings of the proposed system including a site plan, roof plan and connection details for the solar panels. This information will be utilized for approval and construction of the proposed system. B. Description of Structure: Roof Framing: 2x6 dimensional lumber at 24” on center Roof Material: Composite Asphalt Shingles & Rolled Comp Roof Slope: 0, 5 & 30 degrees Attic Access: Accessible Foundation: Permanent C. Loading Criteria Used • Dead Load o Existing Roofing and framing = 7 psf o New Solar Panels and Racking = 3 psf o TOTAL = 10 PSF • Dead Load o Existing Roofing and framing = 7 psf o New Solar Panels and Racking = 3 psf o TOTAL = 10 psf • Live Load = 20 psf (reducible) – 0 psf at locations of solar panels • Ground Snow Load = 40 psf • Wind Load based on ASCE 7-16 o Ultimate Wind Speed = 115 mph (based on Risk Category II) o Exposure Category C Analysis performed of the existing roof structure utilizing the above loading criteria is in accordance with the 2020 Residential Code of New York State. This analysis indicates that the existing framing will support the additional panel loading without damage, if installed correctly. Page 2 of 2 D. Solar Panel Anchorage 1. The solar panels shall be mounted in accordance with the most recent Ironridge installation manual. If during solar panel installation, the roof framing members appear unstable or deflect non - uniformly, our office should be notified before proceeding with the installation. 2. The maximum allowable withdrawal force for a #14 lag screw is 194 lbs per inch of penetration as identified in the National Design Standards (NDS) of timber construction specifications. Based on a minimum penetration depth of 2”, the allowable capacity per connection is greater than the design withdrawal force (demand). Considering the variable factors for the existing roof framing and installation tolerances, the connection using two (2) #14 lag screws with a minimum of 2” embedment will be adequate and will include a sufficient factor of safety. 3. Considering the wind speed, roof slopes, size and spacing of framing members, and condition of the roof, the panel supports shall be placed no greater than 48” on center. E. Solar Panel Anchorage 4. The solar panels shall be mounted in accordance with the most recent Ironridge installation manual. If during solar panel installation, the roof framing members appear unstable or deflect non - uniformly, our office should be notified before proceeding with the installation. 5. Contractor is responsible for the installation and maintenance of all soil erosion and sedimentation control devices throughout the course of construction. 2.Catch basin inlet protection must be installed and operating at all times until tributary areas have been stabilized. When possible flows should be stabilized before reaching inlet protection structure. Timely maintenance of sediment control structures is the responsibility of the Contractor. 3.All structures shall be maintained in good working order at all times. The sediment level in all sediment traps shall be closely monitored and sediment removed promptly when maximum levels are reached or as ordered by the engineer. All sediment control structures shall be inspected on a regular basis, and after each heavy rain to insure proper operation as designed. An inspection schedule shall be set forth prior to the start of construction. 4.The locations and the installation times of the sediment capturing standards shall be as specified in these plans, as ordered by the Engineer, and in accordance with the latest edition of the "New York Standards and Specifications for Erosion and Sediment Control" (NYSSESC). 5.All topsoil shall be placed in a stabilized stockpile for reuse on the site. All stockpile material required for final grading and stored on site shall be temporarily seeded and mulched within 7 days. Refer to soil stockpile details. 6.Any disturbed areas that will be left exposed more than 7 days and not subject to construction traffic, shall immediately receive temporary seeding. Mulch shall be used if the season prevents the establishment of a temporary cover. Disturbed areas shall not be limed and fertilized prior to temporary seeding. 7.All disturbed areas within 500 feet of an inhabited dwelling shall be wetted as necessary to provide dust control. 8.The contractor shall keep the roadways within the project clear of soil and debris and is responsible for any street cleaning necessary during the course of the project. 9.Sediment and erosion control structures shall be removed and the area stabilized when the drainage area has been properly stabilized by permanent measures. 10.All sediment and erosion control measures shall be installed in accordance with current edition of NYSSESC. 11.All regraded areas must be stabilized appropriately prior to any rock blasting, cutting, and/or filling of soils. Special care should be taken during construction to insure stability during maintenance and integrity of control structures. 12.Any slopes graded at 3:1 or greater shall be stabilized with erosion blankets to be staked into place in accordance with the manufactures requirements. Erosion blankets may also be required at the discretion of Town officials or Project Engineer. When stabilized blanket is utilized for channel stabilization, place all of the volume of seed mix prior to laying net, or as recommended by the manufacturer. 13.To prevent heavy construction equipment and trucks from tracking soil off-site, construct a pervious crushed stone pad. Locate and construct pads as detailed in these plans. 14.Contractor is responsible for controlling dust by sprinkling exposed soil areas periodically with water as required. Contractor to supply all equipment and water. 15.Contractor shall be responsible for construction inspections as per NYSDEC GP-0-25-001 and Town of Yorktown Code. MAINTENANCE OF TEMPORARY EROSION AND SEDIMENT CONTROL STRUCTURES: N.Y.S.D.E.C. GP-0-25-001 EXPOSURE RESTRICTIONS - States that any exposed earthwork shall be stabilized in accordance with the guidelines of this plan. 1.Trees and vegetation shall be protected at all times as shown on the detail drawing and as directed by the Engineer. 2.Care should be taken so as not to channel concentrated runoff through the areas of construction activity on the site. 3.Fill and site disturbances should not be created which causes water to pond off site or on adjacent properties. 4.Runoff from land disturbances shall not be discharged or have the potential to discharge off site without first being intercepted by a control structure, such as a silt fence. Sediment shall be removed before exceeding 50% of the retention structure's capacity. 5.For finished grading, adequate grade shall be provided so that water will not pond on lawns for more than 24 hours after rainfall, except in swale flow areas which may drain for as long as 48 hours after rainfall. 6.All swales and other areas of concentrated flow shall be properly stabilized with temporary control measures to prevent erosion and sediment travel. Surface flows over cut and fill areas shall be stabilized at all times. 7.All sites shall be stabilized with erosion control materials within 7 days of final grading. MAINTENANCE OF PERMANENT CONTROL STRUCTURES DURING CONSTRUCTION: The stormwater management system and outlet structure shall be inspected on a regular basis and after every rainfall event. Sediment build up shall be removed from the inlet protection regularly to insure detention capacity and proper drainage. Outlet structure shall be free of obstructions. All piping and drain inlets shall be free of obstruction. Any sediment build up shall be removed. MAINTENANCE OF CONTROLS AFTER CONSTRUCTION: Controls (including respective outlet structures) should be inspected periodically for the first few months after construction and on an annual basis thereafter. They should also be inspected after major storm events. DEBRIS AND LITTER REMOVAL: Twice a year, inspect outlet structure and drain inlets for accumulated debris. Also, remove any accumulations during each mowing operation. STRUCTURAL REPAIR/REPLACEMENT: Outlet structure must be inspected twice a year for evidence of structural damage and repaired immediately. EROSION CONTROL: Unstable areas tributary to the basin shall immediately be stabilized with vegetation or other appropriate erosion control measures. SEDIMENT REMOVAL: Sediment should be removed after it has reached a maximum depth of five inches above the storm water management system floor. INSP. Construction Sequence Refer to the plan set for all plans and details which relate to construction sequence. 1.Prior to the beginning of any sitework the major features of the construction must be field staked by a licensed surveyor. These include the building, limits of disturbance, utility lines, and stormwater practices. 2.Prior to the start of the project, an on-site pre-construction meeting will be held. This will be attended by the project owner, the operator responsible for complying with the approved construction drawings including the erosion and sediment control (E&SC) plan and details, the design engineer, the engineer responsible for E&SC monitoring during construction, town representatives from the engineering department and code enforcement. 3.A licensed surveyor must define infrastructure locations, limits of disturbance, stormwater basin limits, and grades in the field prior to start of any construction. Limits of disturbance shall be marked with the installation of construction fence or approved equal. The extents of the stormwater management system shall be cordoned off to minimize the disturbance on this area. 4.Install all perimeter erosion control measures, construction entrance as shown on the erosion and sediment control plan and the associated details. install silt fencing at the bottom of slopes. The standards established in part 1.b of the GP-020-001 included in appendix b of this SWPPP must be adhered to. 5.Strip site, clear vegetation, and place topsoil in stockpile locations shown on the plan. 6.Begin demolition of existing building and improvements to be removed. All demolition material shall be removed from the site and properly disposed of. 7.Rough grade building, driveway, and parking area. 8.Begin the excavation and installation of the stormwater management system. Protect trenches and open excavations from erosion. Entry into the system shall be blocked off until site has reached final stabilization. Once system has been installed, install plantings, seed where necessary, and reinstall measures to cordon off the system from disturbance. 9.During site construction maintain and re-establish as required erosion control and stabilization measures as required by the site plan and details. 10.Install gravel surface. Statement of Authority. This local law is authorized by the New York State Constitution, the provisions of the New York Municipal Home Rule Law, the relevant provisions of the Town Law of the State of New York, the laws of the Town of Yorktown and the general police power vested with the Town of Yorktown to promote the health, safety and welfare of all residents and property owners in the Town. Section II. Sections 130-5 and 130-6 of the Code of the Town of Yorktown is hereby replaced with the following language: § 130-5. Key lock box requirements. A. All commercial occupancies shall have a rapid entry key lock box installed. The Building Inspector shall ensure a key lock box is installed prior to issuance of a certificate of occupancy. B. The key lock box shall be located at or near the recognized public entrance. The key lock box shall be located at a height of not more than 6 feet and not less than 2 feet above final grade. The location shall be determined by the appropriate Fire District Chief. C. No steps, displays, signs or other fixtures or structural protrusions shall be located under the key lock box which would allow intruders unimpeded access to the box. D. If provided, the key lock box shall be connected to the structure's security alarm system or fire alarm system. The telephone or network connection of the key lock box shall be wired so as to provide a supervisory alarm signal to the central station in the event that the key lock box is opened or removed from the wall. E. The key lock box shall contain the keys for the following, and the keys shall be labeled so as to be easily identified in the field: (1) The main entrance door. Mixed occupancies and strip shopping center keys shall be provided only for occupancies where system control valves or a fire alarm system panel exists. (2) The alarm room (if one exists). (3) Mechanical rooms and sprinkler control rooms. (4) The fire alarm control panel. (5) Electrical rooms. (6) Resetting of pull stations or other fire-protection devices. (7) Elevators. The fire service key shall be a Yale No. 2642 key or the preexisting key. (8) Other rooms as specified during the plan review process or as required during a fire inspection. F. There shall be minimum requirements for the key lock box as outlined below. (1) The lock shall be a MEDICO Biaxial Level 7 or equivalent. (2) Key vaults shall have the ability to be master keyed. (3) Locks shall be designed for high resistance to drilling, picking, punching or pulling. (4) Lock codes and key sections shall be unconditionally restricted by the manufacturer for use by Yorktown and Lake Mohegan Fire Districts. (5) Locks shall be listed under Underwriters Laboratories, Inc., UL No. 437, the standard for safety key locks. (6) Rapid-entry systems shall offer key vaults under UL No. 1610, the standard for central station alarm units for use with UL-listed alarm systems. (7) Rapid-entry systems shall offer key vaults under UL No. 1037, the standard for antitheft alarms and devices. (8) Official Underwriters Laboratories, Inc., listing cards shall be supplied upon request. (9) A fully inserted key shall withstand a minimum of 50 inch-pounds of torque. (10) Key vaults shall have weatherproof gasket seals of neoprene material or better around openings. (11) Key vaults shall have covered lock openings constructed of heavy-gauge steel designed to resist vandalism. (12) Key vaults shall have a minimum wall thickness of 1/4 inch and a door thickness of 1/2 inch plate steel. (13) Cabinet-style vaults for document storage shall have a minimum wall and door thickness of 1 /8 inch plate steel with an additional drill-resistant hard plate to protect the lock mechanism. (14) Cabinet-style vaults for document storage shall be available with two separate locks. The key to either lock shall open the vault. (15) The Yorktown Fire District and the Lake Mohegan Fire District shall be in complete control of rapid-entry system authorization and operation for their fire district. (16) The rapid-entry system shall utilize approved signature(s) from the Chief of the fire district whose fire district covers the structure. In the event that the Fire Chief is not able to sign the order form, he may designate up to two alternates for the Fire District’s approval of the order form. (17) The manufacturer at its factory shall maintain UL-listed fireproof cabinets to protect the original records of the order forms and related records. (18) The factory records shall include installation locations, receiving party signature and Fire 3 District authorized signatures and the original order form. (19) Order records shall be available upon request for inspection by the Building Inspector, the Yorktown Heights Fire District and the Lake Mohegan Fire District. (20) Neither the Town of Yorktown nor the Yorktown Heights and Lake Mohegan Fire Districts shall be required to purchase or sell rapid-entry system products. (21) The Yorktown Heights and Lake Mohegan Fire Districts shall each have separate master keys for their districts so that each master key will be unique to each district. § 130-6. Emergency response repository container unit (lock box) general requirements. The owner or operator of any facility which is required to prepare or have available a material safety data sheet or an emergency and hazardous chemical inventory form under Subtitle B, Sections 311 and 312 of Tide III of the Superfund Amendments and Reauthorization Act of 1986 (SARA Title III), shall provide a repository container (lock box) at the facility site as set forth below. A. The information contained in the repository (lock box) shall include the following information for emergency response personnel: (1) A current list of the key facility personnel knowledgeable about safety procedures of the materials on site, complete with the telephone numbers for each person. (2) A current emergency and hazardous chemical inventory form and a binder containing the material safety data sheets (MSDS) or, in the event that the volume of MSDS sheets is too great to keep practically in the repository container, the location of the on- site MSDS sheets, and the MSDS sheets shall be readily available for use by emergency response personnel. (3) A facility site plan, which shall include the following: (a) The location of storage and use of hazardous materials on site. (b) The location of on-site emergency fire-fighting and spill cleanup equipment. (c) A diagram of the complete sewer system and water system showing fire hydrant and water main locations and sizes. (d) Any building floor plan deemed necessary by the Fire District officials. B. All keying shall be in accordance with the above requirements of the minimum standards for key lock boxes. Section III. Severability. If any clause, sentence, phrase, paragraph or any part of this local law shall for any reason be adjudicated finally by a court of competent jurisdiction to be invalid, such judgment shall not affect, impair or invalidate the remainder of this local law, but shall be confined in its operation 4 and effect to the clause, sentence, phrase, paragraph or part thereof, directly involved in the controversy or action in which such judgment shall have been rendered. It is hereby declared to be the legislative intent that the remainder of this local law would have been adopted had any such provisions been excluded. Section IV. Repeal All ordinances, local laws and parts thereof inconsistent with this Local Law are hereby repealed to the extent of such inconsistency. Section V. Effective Date. This local law shall become effective upon filing in the office of the Secretary of State in accordance with the provisions of the Municipal Home Rule Law. It is the intent of the Town of Yorktown to ensure that peddling and soliciting in the Town is conducted in a safe and peaceful manner without inconvenience to Town residents. This chapter is enacted pursuant to the police power of the Town, Subdivision 8 of § 32 of the General Business Law of the state and any and all other applicable laws, rules and regulations of the state. Nothing contained herein shall be deemed to conflict with any such laws, rules or regulations. § 219-2. Definitions. For the purpose of this chapter, the following definitions shall apply: COMPANY — Any association of individuals, partnerships, firms, corporations, societies or any other organization. ESTABLISHED PLACE OF BUSINESS — A permanent building, store or depository in which or where the person transacts business and deals in goods, wares, merchandise or services in the ordinary and regular course of business. HANDBILL — Any printed or written matter, any sample or device, or any other printed or otherwise reproduced original or copies of any matter or literature, including but not limited to circular, leaflet, pamphlet, paper, or booklet. PEDDLE — To go from house to house, from store to store, from place to place or from street to street, or to deal out, distribute or dispense, to sell and make immediate delivery or to offer for sale and deliver any goods, wares, merchandise or provisions, including books or periodicals, in possession of the seller or any combination thereof at any place within the Town of Yorktown other than from a fixed place of business. PEDDLER — Any individual, firm, partnership, corporation, unincorporated association and any principal or agent thereof who, in any street or public place or by going from house to house or from place to place or any combination thereof, on foot or from any vehicle, sells, barters, offers for sale or barter or carries or displays for sale or barter, any goods, wares, merchandise or services. For the purposes of this chapter, the entity which engages a person as their agent for the purposes of peddling is also considered a peddler within the meaning of this section and is subject to the provisions of this chapter. The words "peddler," "hawker" and "huckster" are considered synonymous terms. PUBLIC PLACE — Any street, sidewalk, alley or other public way and public park, square, space or grounds or any publicly owned or leased land or buildings. SOLICIT — To go from house to house, from store to store, from place to place or from street to street to sell or take orders for goods, wares, merchandise or provisions, including books or periodicals, for future delivery, or for services to be performed at any place within the Town of Yorktown, or to distribute advertising matter. SOLICITOR — Any person, either principal or agent, traveling either by foot or by any conveyance from place to place, from house to house or from street to street or any combination thereof, who takes or offers to take orders for the sale of any goods, wares or merchandise, for present or future delivery or for the performance of future services, whether or not he or she collects advance payments for such sale or service. For the purposes of this chapter, the entity which engages a person or his or her agent for the purpose of soliciting, is also considered a solicitor within the meaning of this section and is subject to the provisions of this chapter. STATIONARY LOCATION — Includes any point or distance within 0.3 of a mile in all directions of a stationary location. VEHICLE — Any motor vehicle as defined in the Vehicle and Traffic Law of New York. VEND — To peddle, hawk, sell, barter or lease, or to offer to sell, barter or lease, or to display for sale, barter or lease any goods, wares, merchandise or services in a public place. § 219-3. License required. It is prohibited to engage in itinerant trading, hawking and peddling or making a sale by sample and taking orders for future delivery of goods, produce, wares, books, magazines and periodicals or merchandise of any description, in or upon the public highways or public places of the Town or upon private property, by calls from house to house, without obtaining a license as herein provided. A license must be obtained by each individual who peddles or solicits, regardless of whether or not he or she is affiliated with a company, firm, partnership, corporation, unincorporated association or is a principal or agent thereof of any entity which engages a person as their agent for the purposes of peddling. § 219-4. Exemptions. Such prohibition shall not apply to: The peddling of meats, fish, fruit and farm produce by farmers and persons who produce such commodities, nor does it apply to any person, firm or corporation who operates a regularly established place of business within the Town of Yorktown to which orders may be given through a delivery man, nor does it apply to any charitable, educational, fraternal or religious organization. A sale conducted pursuant to an order of any court. A child 18 years of age or under who resides within the Town of Yorktown and who solicits or peddles on behalf of a charitable, religious, athletic, social, educational or civic organization, including but not limited to Scouting America or clubs, classes or organizations sponsored by a public or private school. A not-for-profit-organization's sale of food ancillary to a fundraising event, such as a picnic or carnival, that lasts no longer than five consecutive days. This exemption shall not apply to any door-to-door peddling or soliciting. § 219-5. Fees. Trucks and conveyances. The license fee payable by each peddler for each unit, truck or any conveyance carrying wares shall be in accordance with the Town’s Master Fee Schedule. The license is to be displayed in the vehicle at all times while soliciting in the Town of Yorktown. The license fee for each solicitor or peddler going from door to door shall be in accordance with the Town’s Master Fee Schedule. § 219-6. Filing of application; criminal history check. Any person desiring a license, as herein provided, shall file with the Town Clerk a written application therefore duly verified by the applicant upon blank forms provided by the Town Clerk. A license may be taken out only by an individual and not in the name of a firm, corporation, association, club or other group. Such application shall include, but not be limited to, the following information: The name, address, date of birth, social security number and motorist identification number of said person, and the name of any corporation, firm, association, club, partnership or other organization involved. A description of the type of goods, wares and/or merchandise that the applicant wishes to sell or solicit orders for. A description of the vehicle that the applicant wishes to use in carrying out his/her business or occupation. The owner of the vehicle and registration details thereof. The County Health Department permit number, if a food vendor. If peddling or soliciting for a corporation, the date of incorporation, state in which it is incorporated and name, address, date of birth and social security number of all officers. Whether applicant has ever been convicted of a crime and, if so, under what name, with a listing of such convictions, including crime, jurisdiction, date and sentence imposed. All applicants must be fingerprinted by a third-party agency under contract with the New York State Division of Criminal Justice Services [DCJS]. Applicants shall be responsible for the fingerprinting fee, the processing fee and all other associated fingerprinting fees. The third-party agency will then submit the fingerprints to the DCJS for a criminal background investigation. The Town of Yorktown Police Chief and/or his or her designee shall be responsible for reviewing the criminal history record information (CHRI) disseminated by DCJS. All applicants are responsible for ensuring that their background check and any CHRI, including but not limited to any information provided by DCJS, is provided to and reviewed by the Police Chief and/or his or her designee prior to any application being determined by the Town Clerk. Each applicant must file with his/her application two unmounted, unretouched photographs of himself/herself, 1 1/4 inches by 1 1/2 inches in size, taken within 30 days preceding the filing of the application. One photo shall be attached to the license when issued, the other shall be affixed to the application. Any decision regarding a prospective applicant's fitness for a permit based upon a conviction contained in the criminal history background information obtained from the DCJS must be made upon consideration of New York State Correction Law §§ 701 through 703-b and §§ 751 through 753. § 219-7. Method of issuing license or denial of license; conditions; fee; appeals. The Town Clerk, with such assistance from the Police Department as may be reasonably necessary, shall investigate all applications and shall, thereafter, issue or deny said license to the applicant. The Town Clerk shall refuse issuance of a license to any person who has been convicted of a felony. The license shall automatically expire on December 31 following the date of its issuance. The date of issuance and expiration of the license, as well as the purpose for which it has been issued, shall be set forth on the face thereof. The license shall be carried on the person of the licensee at all times while being exercised and shall be exhibited by the licensee to any person on demand thereof. A picture of the applicant shall appear on the valid license with the Town Seal imprinted on same. The license shall not be transferable or assignable. In the event that a licensee shall permit any person other than himself/herself to possess or use such license, such license shall automatically be revoked, and the licensee shall thereby be guilty of violating this chapter, and no application for a future license may be made for a period of one year from the date of revocation. The license is good only for the purposes stated thereon, and any change of product being sold or offered for sale, without written consent from the Town Clerk, shall constitute cause for revocation of the license, and the licensee shall thereby be guilty of violating this chapter, and no application for a future license may be made for a period of one year from the date of revocation. If a Board of Health or other county permit is required, the sale of a product not covered by such permit shall be a violation of this chapter, and no application for a future license may be made for a period of one year from the date of revocation. An applicant who has had a license denied or revoked by the Town Clerk may appeal to the Town Board in writing. The Town Board will thereafter hold a public hearing to review the determination of the Town Clerk. § 219-8. Special provisions for veterans. Any honorably discharged member of the Armed Forces of the United States, holding a license pursuant to § 32 of the General Business Law, must file an application with the Town Clerk for the issuance of a local license under the same conditions as any other peddler. No fee shall be required of any such Veteran of the Armed Forces of the United States, except that conveyances not owned by such Veteran shall be licensed at the usual fee. § 219-9. Stationary locations. No licensed hawker, peddler or solicitor shall permit any cart, wagon or vehicle owned or operated or controlled by him to stand stationary or remain stationary, nor shall he sell or offer for sale therefrom or from any pack or container any goods, wares or merchandise of any kind within the lines of any street, highway or sidewalk in the Town of Yorktown, within 300 feet of any schoolhouse or school grounds or within 1,500 feet of any public market or store engaged in the business of selling the same goods, wares and merchandise offered by the licensee, or in front of any premises if the owner or any lessee thereof objects thereto. No peddler or solicitor shall have any exclusive right to any location in any street or on any public property, nor shall any peddler or solicitor be permitted to occupy any stationary location in any street or on any public property without the express permission of the Town Clerk. No person may peddle or solicit in any congested place or area when or where such activity may impede or inconvenience the public or add to the congestion of such place or area. For the purpose of this subsection, the judgment of any peace officer or police officer, exercised in good faith, shall be deemed conclusive as to the existence of congestion and as to whether the public is impeded or inconvenienced. § 219-10. Penalties for offenses. Any violation of this chapter shall be a misdemeanor and may be punishable by a fine not exceeding $500 or by imprisonment not exceeding 30 days, or by both such fine and imprisonment. § 219-11. Hours of operation. Unless otherwise authorized by the Town Clerk, no person shall peddle or solicit in the Town except during the hours from 9:30 a.m. to 7:30 p.m. on Monday through Saturday of each week, other than legal holidays. This limitation on days and hours shall be set forth on each license issued pursuant to this chapter. No person shall solicit or peddle in the Town parks during the hours of operation of the concession stands as posted at the entrance of the pool facilities, day camps and concession stands without the prior written approval of the Superintendent of Recreation and Parks. § 219-12. Do-Not-Knock Registry. Any owner or occupant of residential property located in the Town who wishes to prohibit soliciting and peddling on the premises shall complete a form available in the Town Clerk's Office and on the Town's website. The completion of the form will allow the owner/occupant's premises to be included on a list of properties that do not permit solicitation or peddling (herein referred to as the "Do-Not-Knock Registry" or "Registry"). In order to be removed from the registry, the owner and/or occupant must complete a form indicating that he/she does not want his/her property to be included on the registry. Any owner and/or occupant who has requested enlistment on the Do-Not-Knock Registry, pursuant to this chapter, shall be able to purchase from the Town, for a nominal fee, a sticker or sign for display indicating enlistment on the Do-Not-Knock Registry. All solicitors and peddlers shall obtain the current Do-Not-Knock Registry at the time of issuance of a permit or at the time of registration to solicit pursuant to the provisions of this chapter. Solicitors and peddlers shall not solicit or peddle at any premises identified on the then current Do-Not- Knock Registry. It shall be the responsibility of the solicitor and peddler to check each residence for the presence of such signage and to obtain updated copies of the registry. Solicitation in connection with political, educational, charitable, religious or other non-commercial purposes shall not be subject to the provisions of this section regarding the Do-Not-Knock Registry. It shall constitute a violation of this chapter punishable under § 219-10 for any registered peddler or solicitor to go upon any property or premises for the purpose of engaging in soliciting or peddling where the property or premises is included on the Do-Not-Knock Registry. § 219-13. Transferability. Such licenses shall not be transferable and shall not be valid for the use by any agent or employee of the licensee. § 219-14. Statement of Authority. This local law is authorized by the New York State Constitution, the provisions of the New York Municipal Home Rule Law, the relevant provisions of the Town Law of the State of New York, the laws of the Town of Yorktown and the general police power vested with the Town of Yorktown to promote the health, safety and welfare of all residents and property owners in the Town. Section II. Section 240-8 of the Code of the Town of Yorktown is hereby amended in its entirety by replacing it with the following language: A. For the purpose of adequately funding the operation of the Yorktown Heights Water Pollution Control Plant and the various sewer systems within the Town of Yorktown, said treatment plant and/or sewer systems shall be consolidated into two operating zones, the definitions of which are as follows: (1) The Yorktown Heights Water Pollution Control Plant, operated and maintained by the Town of Yorktown, together with the areas actively serviced by said plant, shall constitute the Hallocks Mill sewage treatment operating zone. (2) Each area in the Town of Yorktown serviced by a functioning sewer system operated and maintained by the Town of Yorktown, but not serviced by a sewage treatment plant operated and maintained by the Town of Yorktown, shall constitute the Peekskill lateral sewer operating zone. B. Moneys shall be collected from owners of residences, commercial establishments and structures receiving Town-operated and maintained sewer service (Town sewer service) within an operating zone. The total funds collected within a zone shall be sufficient to meet the operating and maintenance (O &M) costs of that zone. C. Whenever a residence, a commercial establishment or a structure, beyond the boundaries of an operating zone, receives Town sewer service, that residence, commercial establishment or structure shall become a part of that sewage treatment operating zone for purposes of carrying its portion of the operating and maintenance charges, and Subsection B hereof shall apply. D. Any property that benefits from a previously established lateral sewer zone shall pay a buy-in charge based on district equity. E. The Yorktown Heights Water Pollution Control Plant, with its ancillary trunk sewers, lateral sewers and pump stations, together with those residences, commercial establishments and structures serviced by this sewage treatment system, shall constitute the Hallocks Mill Sewage Treatment Operating Zone. The O & M charges for this zone shall be as follows: 2 (1) Residences, commercial establishments and other structures located within the boundaries of the Hallocks Mill Sewage Treatment Operating Zone (Hallocks Mill Sewer Drainage Basin) which receive sewer service from the zone shall be charged a rate based on water consumption. This computed rate shall occur only when the fixed rate specified in Subsection E(2) is exceeded due to consumption. The current rate for sewer services shall be billed at a rate as set forth in the Master Fee Schedule per 1,000 gallons of water consumption. The minimum charge for a four-month billing cycle shall be based upon minimum water usage of 13,000 gallons. (2) Residences, commercial establishments and other structures located within the boundaries of the Hallocks Mill Sewage Treatment Operating Zone which receive sewer service from the zone shall be charged a minimum flat rate tax to defray fixed operation and maintenance costs. F. The properties connected to the Westchester County Peekskill Sewer Plant, and not included in any Town lateral sewer operating zone, shall be included in the Peekskill Lateral Sewer Operating Zone. The Peekskill Lateral Sewer Operating Zone, with its ancillary lateral sewers and pump stations, together with those residences, commercial establishments and structures serviced by Westchester County Peekskill Sewage Treatment Plant, shall constitute the Peekskill Lateral Sewer Operating Zone. The O & M charges for this zone shall be as follows: residences, commercial establishments and other structures located within the boundaries of the Peekskill Lateral Sewer Operating Zone which receive sewer service from the zone shall be charged a rate based on water consumption. This computed rate shall be charged to defray variable operating and maintenance costs. The current rate for sewer service shall be billed as set forth in the Master Fee Schedule[3] per 1,000 gallons of water consumption. The minimum charge for a four-month billing cycle shall be based upon minimum water usage of 13,000 gallons. G. The charges for operation and maintenance to be paid by those residences, commercial establishments and structures within an operating zone shall be set by the Town Board. H. The Town Board shall review the operating zones' charges annually. These charges shall be revised periodically to sufficiently reflect the actual operation and maintenance costs that accrue to the respective operating zone. Section III. Severability. If any clause, sentence, phrase, paragraph or any part of this local law shall for any reason be adjudicated finally by a court of competent jurisdiction to be invalid, such judgment shall not affect, impair or invalidate the remainder of this local law, but shall be confined in its operation and effect to the clause, sentence, phrase, paragraph or part thereof, directly involved in the controversy or action in which such judgment shall have been rendered. It is hereby declared to be the legislative intent that the remainder of this local law would have been adopted had any such provisions been excluded. Section IV. Repeal All ordinances, local laws and parts thereof inconsistent with this Local Law are hereby repealed to the extent of such inconsistency. 3 Section V. Effective Date. This local law shall become effective upon filing in the office of the Secretary of State in accordance with the provisions of the Municipal Home Rule Law.
