As volunteer supervisors for the NYNJTC, we have been asked to comment on the impact of the mitigation proposed by Nantucket Sound Sons LLC in the Amended Site Plan Application for the Mohansic Trailway access on Baldwin Rd. NYNJTC trail maintainers are responsible for clearing vegetation on a path sufficiently wide and high enough so that users can easily walk the trail without touching surrounding growth. On boardwalks, maintainers trim and remove vegetation directly on the trail and within 12–18 inches of the boardwalk edge. The applicant proposes removing invasive Japanese knotweed, multiflora rose, and Japanese barberry, and replanting the trail entry area with native species. These invasives grow rapidly and heavily encroach on the trail, so their removal should improve conditions and support routine maintenance needed to keep the trail accessible. However, eliminating Japanese knotweed and restoring the area with native plants is a long-term effort requiring a multi-pronged, multi-year strategy that should extend beyond the two proposed interventions and the one-year post-planting guarantee. Basic establishment of a restored area typically takes 3–5 years, while developing a robust, resilient ecosystem can take 5–10 years with continued invasive-species management. The plan also calls for protecting an existing patch of Queen Anne’s lace, but because this species is non-native, often considered invasive, and classified as a noxious weed in some states, special protection is not necessary. The applicant also proposes installing two benches along the trail. Because the boardwalk is designed to be accessible, the placement of benches should not reduce the current trail width. NYNJTC volunteers are responsible for maintaining trail infrastructure such as boardwalks and bridges but not park infrastructure such as benches; any issues with these are promptly reported to the Parks and Recreation Department. The P&R Department can advise on the type of bench that would be appropriate for a high-use site exposed to the elements. The contractor can get the permit before spring. It will be a condition of the approval. Are you able to attend Monday night? The site plan is being amended to deal with the HVAC situation which results in the change and increase in mitigation plan work the contractor will perform. The focus of the discussion will be on the site plan andfinalizing the approval. The only questions for the contractor will be when and how the work will be done if the Board wants clarification. Is there any type of wetland scientist that will follow the mitigation to certify it is done properly? Or anyone on staff with the contractor that can enumerate steps that are completed during the process? Robyn ************************************************* Robyn A. Temporary building or structure. [Amended 7-17-2012 by L.L. No. 10-2012] A. A temporary building or structure may be erected and maintained for a period of one year in conjunction with the construction of a lawfully permitted use or facility in the district in which such use or facility is located. An extension of the time period may be granted in the discretion of the Town Board for good cause shown, provided that construction of the permitted use or facility is still in progress. B. The Town Board shall have the discretion to limit the size, floor space, dimensions, height and use of the temporary building and/or structure for which an application is made upon consideration of lot area, building/structure use and other articulated consideration that in the Board's discretion may be appropriate. C. No temporary building or structure shall be closer than 20 feet from any property line. D. A plot plan in accordance with the general requirements in § 300-195 shall be filed with the Town Board. A temporary building permit shall be required for each separate building or structure. E. The applicant for such permit shall deposit the sum of $1,000 with the Town Clerk to ensure the removal of said building or structure upon the expiration of the time period as set forth in the building permit. In the event that said building or structure is not so removed, then the Building Inspector or any deputy, assistant or employee of the Building Inspector's office designated by him may enter upon any lands within the Town, without hindrance, for the purpose of removing, destroying or otherwise disposing of any such building or structure. The cost of such work shall be charged to said cash deposit and the balance remaining, if any, shall be remitted to the applicant at his last known address. F. Where the plot plan shows the construction of more than one temporary building or structure, the Town Board may require a deposit of only $1,000 for all of such construction, if said sum is deemed sufficient to ensure the removal of all temporary buildings or structures, because of the nature and extent of the same. 10/2/26, 4:00 PM Temporary building or structure. - Town of Yorktown, NY https://ecode360.com/print/YO1560?guid=6854111 1/1 3611 Gomer Street Solar Robyn A. At that time, it was explained to them that the site plans must be revised to reflect the current proposal that complies with Town Code (aside from the lot area). Revised plans should show the following: 1. Indicate pool will remain. 2. Show ground-mounted array that complies with setbacks. 3. Show all existing landscaping and proposed landscape screening for neighboring properties. 4. Add the proposed height of the panels to the panel cross-section shown on sheet 3. 5. Create an alternative plan with solar panels on the roof and smaller ground-mounted array. Essential Power has indicated that a representative familiar with the plans will present the revisions at the August 10, 2026 meeting. Even with these revisions, the Board must determine whether to recommend the area variance be granted for this application. The Town Board adopted the latest revisions to the Town Code on March 17, 2026 and these revisions reaffirmed all small-scale ground-mounted solar systems “in residential districts shall be installed on properties that are a minimum of two acres in size or more.” This recommendation should only be considered if there were unique conditions on the subject property that would set it apart from any other property of similar size that could request the same area variance. The proposed array consists of 50 solar modules and 50 microinverters and will be positioned in the rear yard. The property has a single-family home and a pool. The pool will be removed to facilitate the construction of the solar array. Earlier this year, Chapter 300 of the Yorktown Town Code was amended to restrict the development of large- scale ground-mounted solar arrays within residential zones. Special use permits and site plans for small-scale ground-mounted solar arrays within residential zones are still permitted but require Planning Board review and approval. At its meeting on May 28, 2026, the Applicant met with the Zoning Board of Appeals to discuss an area variance for the proposed solar installation. The ZBA informed the applicant that they should start the site plan and special use permit review with the Planning Board before they can consider any variances. The site plan does not currently comply with the code requirements listed below: 1. Proposed setback is 14’ where 30’ is required. 2. Proposed panel height shall not exceed 10’. Please provide panel height. 3. Lot area is 1.71-acres where 2-acres is required. Based on an initial review by Planning Department staff, a robust landscaping plan may be required as Yorktown Town Code Section 300-81.4E(3)(e) requires screening from adjacent residential properties, streets, or roads on which it fronts or is visible from, as well as any other views which the Planning Board determines necessary. No tree removal was indicated on the site plan; however, the Applicant informed the ZBA that tree removal may be necessary. Both items will impact the visibility of the proposed solar array and must be considered. Respectfully submitted, Ian P.
